A substantial literature shows that ideology, often describable on a conservative-liberal spectrum, is a significant independent variable influencing the formulation of public policy. The 1960s–1990s are frequently depicted as decades of ideological tumult. However, analysis of the editorials of major publications shows that substantial agreement existed on public policy directions for business and the economy throughout most of these years. Furthermore, in some policy areas initial dissensus was followed by significant movement toward consensus. A theory presented here based on the concepts of successful market operation, market misbehavior, and market breakdown explains in large part the reasons for this long term policy consensus as well as movement from dissensus to consensus. 相似文献

This paper outlines and evaluates the nature of terrorism as perpetrated by al-Qaeda. To begin it graphs the institutional blueprint of society, and identifies the ubiquitous relationship between state, market and culture in any society. It goes on to describe how private markets and cultures are harmed and diminished by the relative expansion of the state. At some stage in this relative expansion, private markets and cultures simply collapse. At this point, a societal backlash ensues. al-Qaeda, in this sense, is the modern day coup d'etat against the overwhelming power of an over-extended autocracy. The paper evaluates this hypothesis through an institutional examination, largely focused on Saudi Arabia, the initial homeland of Osama bin Laden, the highly effective leader of al-Qaeda, and current home to the world's largest financial contributors to the cause of al-Qaeda. Understanding the specific and purposeful institutional nexus from which al-Qaeda has emerged must be a first step in any systematic attempt to reduce the terrorist threat that it poses. 相似文献

In recent years, the coupling of poor outcomes for rape victims in criminal court and the widening scope of legal responsibility for sexual assault has prompted plaintiffs to file civil suits for rape against corporations. Unfortunately, we know little about juror perception of civilly litigated rape against corporate defendants and most jury research involving corporate defendants concerns non-sexual injury cases (e.g. premises liability, automobile accidents). With the increasing number of corporations being sued civilly for rape, we need to understand how civil juries perceive these cases. The present study investigated mock jurors’ perceptions of a fictional civil rape trial against a hotel. Community members (N?=?155) read one of three trial summaries: Civil rape trial against the alleged perpetrator, civil rape trial against a hotel, or criminal rape trial. Results indicate females have higher pro-plaintiff judgments than males in civil court, perceptions of greed typically associated with civil litigation apply to rape, and favorable plaintiff decisions are most likely against a corporate defendant. Also, mental models suggest mock jurors conceptualize criminal and civil rape cases against an individual similarly. We discuss our results in terms of psychological, legal and practical expectations when suing for rape. 相似文献

The political and economic debacle in Zimbabwe has led to a large-scale influx of Zimbabweans into neighbouring South Africa. This article argues that there is a complex and significant link between the domestic response to this immigration influx and South Africa's foreign policy towards Zimbabwe. South Africa's foreign and security policy elite preferred to use an immigration approach of benign neglect as a tool to promote its ‘quiet diplomacy’ approach towards the Zimbabwean regime, treating the influx as a ‘non-problem’. But increased xenophobic violence, vigilantism and protests in townships and informal settlements against Zimbabwean and other African immigrants, culminating in widespread riots across the country in 2008, contributed to a change not only in immigration policy but also in the mediation efforts towards the Zimbabwean parties. I argue that this foreign policy change was pushed by a process of ‘securitisation from below’, where the understanding of Zimbabwean immigrants as a security threat were promoted not by traditional security elites but by South Africa's marginalised urban poor. 相似文献

We present an oxcarbazepine-related fatality together with an overview of 26 postmortem cases involving oxcarbazepine observed during the period 2001-2006. The fatality case concerned a 27-year-old woman with epilepsy, who was found dead in her bed. Oxcarbazepine and its active metabolite, 10-hydroxycarbazepine, were the only compounds detected. The concentrations of oxcarbazepine were as follows: femoral blood, 2.9mg/kg; muscle, 1.8mg/kg; liver, 0.9mg/kg; gastric content (300ml), 860mg/kg; and vitreous humour, not detected. The concentrations of 10-hydroxycarbazepine were as follows: femoral blood, 66mg/kg; muscle, 40mg/kg; liver, 62mg/kg; gastric content, 27mg/kg; and vitreous humour, 25mg/kg. The analyses were performed by HPLC-DAD after liquid-liquid extraction. Oxcarbazepine intoxication was regarded as a possible cause of death. For the other 26 cases, the 10-hydroxycarbazepine concentrations ranged from 2.2 to 48mg/kg with a median of 25mg/kg. 相似文献

Der vorliegende Beitrag analysiert – unter Bezugnahme auf eine ländervergleichende empirische Studie derselben Autoren – die Verhaltensregeln für Parlamentarier und die daraus resultierenden Konsequenzen. Dabei wird zunächst auf die Frage eingegangen, was unter Transparenzpflichten verstanden wird.
