In anthropological and legal literature, the phenomenon termed ‘legal pluralism’ has been interpreted as a co-presence of legal orders which act in relation to their own ‘levels’ of referring ‘fields’. The Afghan normative network is generally described in terms of pluralism, where different normative systems such as customs, shari’a (Islamic law), state laws and principles deriving from international standard of law (e.g., human rights) coexist. In order to address the crucial question of access to justice, in this article, I stress the category of legal pluralism by introducing the hypothesis of an inaccessible normative pluralism as a key concept to capture the structural injustices of which Afghans are victims. Access to justice can be considered a foundational element of every legal project. Globally, the debates concerning the diffusion and application of human rights develop at the same time ideologically, politically, and pragmatically. Today in Afghanistan, these levels are expressed in all their complexity and ambivalence. It is therefore particularly significant to closely observe the work done by the Afghanistan Independent Human Rights Commission and to discuss the issue of human rights by starting from a reflection on what might be defined a socio-normative condition of inaccessibility.  相似文献

Abstract

The American ‘return’ to East Asia is currently characterized by a particularly high degree of competition with Beijing among the small and medium powers of Southeast Asia, where the recent Chinese ‘charm offensive’ achieved its most significant outcomes.

This article, hence, aims to explore the nature and patters of this ongoing process of strategic repositioning put into practice by Myanmar within the political triangle with Washington and Beijing. Against this backdrop, we will draw upon the conceptualization of ‘hedging strategy’, which identifies a set of multidimensional ‘insurance policies’ adopted by small actors in their relations vis-à-vis great powers.  相似文献

ABSTRACT

The usefulness of performance indicators increases when organizations compare their data. However, most discussions have failed to emphasize two lines of action that could improve the relevance of such comparisons: a) agreement among service managers on the indicators to be used in the evaluation; b) homogenization of the indicators to be used by organizations, and of the process used to calculate them. In this context, this paper proposes a methodology based on the participation of and consensus among managers, which helps to standardize the construction and presentation of performance indicators. The aim of this proposal is to improve the comparative evaluation of organizations. Finally, in order to test the proposal, a practical application is carried out on the local culture departments of nine large municipalities in southern Spain.  相似文献

ABSTRACT

The search for enhanced transparency and accountability in government organizations has inspired studies to identify the key factors that facilitate greater disclosure of public financial information. With the advantages provided by the meta-analysis technique, applied to a sample of studies, we identify the most significant factors and incentives underlying the decisions adopted by public managers on policy strategies regarding information transparency and public responsibility. Our study shows the variables analyzed to be positively associated with the disclosure of public financial information, but also that this depends on the context in which the research is carried out. The most influential variables were the moderator variables of the administrative culture and of the measurement unit for the variables.  相似文献

The authors report an unusual case of suicide of an anesthesiologist, in which the suicide manner and means depend upon the victim's occupation. This is the first case report published in Italy of a death involving propofol and other drugs. The anesthesiologist was found dead with an empty drip still inserted in the hand and another one near his body. Forensic and toxicological findings suggested that the cause of death was a respiratory depression due to a self‐administration of a rapidly infused lethal drug mixture. Analytical drug quantification was performed by gas chromatography‐mass spectrometry. Blood analysis revealed: zolpidem (0.86 μg/mL), propofol (0.30 μg/mL), midazolam (0.08 μg/mL), thiopental (0.03 μg/mL), and amitriptyline (0.07 μg/mL). Adipose tissue and hair analysis suggested a previous and repeated use of these drugs verifying the fact that in Italy recreational abuse of anesthetic and sedative agents in health care practitioners is becoming an increasing problem.  相似文献

While China will probably become more proactive in its multilateral diplomacy and increase its influence in global multilateral settings, various concerns and constraints make it unlikely that it will completely overhaul or even dramatically reshape the multilateral architecture at the global level. Stuck in defining its identity, China is caught up between posturing as a leader of the developing world on some policy issues and siding with the developed countries on others. This article has two principal objectives: (1) to study the behavioral dimensions of Muslim prisoners which predict their Islamist radicalism and (2) to study whether the behavior manifested by them is higher in prisons with a greater concentration of Muslims and a higher presence of prisoners convicted for Islamist terrorism than in prisons with fewer Muslims and no convicted Islamist terrorists. We conclude that some Spanish prisons may provide favorable social environments for jihadist radicalism and that the questionnaire utilized is a useful diagnostic tool for evaluating the magnitude of this phenomenon.  相似文献

Reversing the retreat of the Yeltsin era, Russia has returned to Central Asia proactively. Its presence is increasingly felt in the traditional–that is, security–field and in new fields of engagement, such as strategically-placed investment or construction of regionalism. The cultural and “civilisational” role has also gained more prominence. Moscow's policy reflects pragmatic opportunism, aimed at getting the utmost benefits for Russia from a region in which it holds many assets rather than at a revival of the former empire. There are limits however as to how far its engagement can go due to constraints posed by Central Asian realities and Russian domestic developments. So far, the advance has been greatly facilitated by the West's retreat, giving rise to perceptions of an unfolding “great game”, while in reality a record of both competition and cooperation between Russia, China and the West is a normal state of affairs. Although Central Asian elites find it easier to deal with Moscow in the current political climate, they view its assertive role with caution and may turn to a rival suitor should the price for the relationship with Russia become too high.  相似文献

Over the past decades, university-industry relationships have become an important subject due to the essential role played by technological progress in the economic development of countries. From a theoretical point of view, several studies have shown the close relationship between investments in research and innovative activities of universities and the economic growth of specific territories. Indeed, the strong linkages between universities and a country’s production system encourage the process of technology transfer and the commercial use of the research results. For this reason, the European Union has implemented a series of measures to promote the adoption of research findings in the real economic and social context, strengthening the linkages between universities, industries and government. As a starting point for enhancing this link, specific mechanisms have been devised by universities. In particular, technology transfer offices (TTOs) have been created to stimulate and encourage the dissemination of the research outcomes, translate them into practise, and facilitate their interrelations with the other two agents of the innovation systems: industries and government. Within this context, the present paper aims to gain knowledge on the determinants of spin-off creation in Italy with special attention to the role played by university TTOs. Specifically, an econometric probability model has been built merging the extant literature into four distinct strands. The analysis, based on the NetVal indicators and primary data survey, has allowed us to assess the Italian experience at an aggregate and disaggregate level.  相似文献
