Werbungskosten ab Vermietungsabsicht (auch bei ursprünglich selbst bewohnter und noch leerstehender Wohnung)

Ist der endgültige Entschluss, eine Wohnung zu vermieten durch ernste und nachhaltige Vermietungsbemühungen belegt, so liegen (vorab entstandene) Werbungskosten auch für die Zeit vor, in der die zun?chst selbst bewohnte Wohnung noch leer steht.     

Alleinvermietung durch Miteigentümer

Vermietet der H?fteeigentümer eines Hauses eine bestimmte Wohnung, an der ihm das alleinige Nutzungsrecht zusteht, so sind die daraus erzielten Mieteinkünfte ihm (allein) zuzurechnen. Einer Zurechnung steht nicht entgegen, dass die Vermietung eben dieser Wohnung beim Rechtsvorg?nger (beim Exgatten) Jahre zuvor als Liebhaberei beurteilt worden ist. Jedes Mietobjekt ist grunds?tzlich danach zu untersuchen, ob es eine Einkunftsquelle im Rahmen von Einkünften aus Vermietung und Verpachtung bildet.     

Überdurchschnittlich großes Arbeitszimmer (ca 150 m<Superscript>2</Superscript>)

Der Einwand der Amtsbeschwerde, ein repr?sentatives Arbeitszimmer (Haush?lfte) im Ausma? von etwa 150m², das auch für Besprechungen verwendet wird, sei kein Arbeitszimmer, ist unberechtigt. Für die AfA ist beim Arbeitszimmer auf die tats?chliche Nutzungsdauer abzustellen. Die lit e (1,5% AfA) ist beim Arbeitszimmer unanwendbar, weil dieses nicht der Erzielung von Einkünften aus Vermietung und Verpachtung dient.     

Auch der Rechtsnachfolger des ausgeschlossenen Wohnungseigentümers kann die Ausschlussbestimmung nicht mit Individualantrag bekämpfen

Auch einem Rechtsnachfolger eines aus der Miteigentümergemeinschaft ausgeschlossenen Wohnungseigentümers steht kein Recht zu, mittels Individualantrages die Ausschlussbestimmung (auf Grund derer der Ausschluss erfolgt ist) beim VfGH zu bek?mpfen.     

Unzulässigkeit eines Individualantrages auf Aufhebung des Mietrechtlichen InflationslinderungsG

Der Individualantrag eines Hauseigentümers auf Aufhebung des Mietrechtlichen Inflationslinderungsgesetzes betreffend die ?nderung von Richtwerten ist infolge Zumutbarkeit der Beschreitung des gerichtlichen Rechtsweges in einem mietrechtlichen Au?erstreitverfahren unzul?ssig und daher zurückzuweisen.     

Support for the environment post-transition? Material concerns and policy tradeoffs

Though many individuals are aware of the need to address environmental concerns, fewer are willing to pay for climate action or think the environment should be a priority for government spending. One compelling reason is that they prioritize using scarce resources to address immediate material concerns. This is particularly likely for individuals facing absolute material scarcity or for those who think they are relatively economically worse off, especially in contexts characterized by rapid transformation and volatility in the levels and quality of social welfare provision. To test these expectations, we analyze survey data from formerly Communist economies, which today find themselves with vastly different fortunes. Empirical findings suggest that absolute and relative material scarcity affect opinions regarding government spending on, and the willingness to pay more for, environmental action. However, willingness to pay more for government public services, inclusive of anti-poverty initiatives, has an impact on willingness to pay more for climate action, but in counter-intuitive ways. Overall, the results appear to suggest that explicitly addressing and relating individual living standards and inequality with environmental concerns may expand support for climate action.     

Attributions of Blame and Responsibility in Sexual Harassment: Reexamining a Psychological Model

Kelley’s (Nebr Symp Motiv 15:192–238, 1967) attribution theory can inform sexual harassment research by identifying how observers use consensus, consistency, and distinctiveness information in determining whether a target or perpetrator is responsible for a sexual harassment situation. In this study, Kelley’s theory is applied to a scenario in which a male perpetrator sexually harasses a female target in a university setting. Results from 314 predominantly female college students indicate that consistency and consensus information significantly affect participants’ judgments of blame and responsibility for the situation. The authors discuss the importance of the reference groups used to derive consensus and distinctiveness information, and reintroduce Kelley’s attribution theory as a means of understanding observers’ perceptions of sexual harassment.     

Growing Stem Cells: The Impact of Federal Funding Policy on the U.S. Scientific Frontier

This paper articulates a citation‐based approach to science policy evaluation and employs that approach to investigate the impact of the United States’ 2001 policy regarding the federal funding of human embryonic stem cell (hESC) research. We evaluate the impact of the policy on the level of U.S. hESC research, the U.S. position at the knowledge frontier, and the strategic response of U.S. scientists. Consistent with recent research on the science of science and innovation policy, we employ a difference‐in‐differences approach using bibliometric data with the aim of analyzing the causal impact of the policy on cumulative research. Our estimates suggest that in the aftermath of the 2001 policy, U.S. production of hESC research lagged 35 to 40 percent behind anticipated levels. However, this relative decline was largely concentrated in the years 2001 to 2003 and ameliorated over time. The rebound in U.S. hESC research after 2003 was driven by contributions by researchers at elite U.S. institutions and U.S. researchers who collaborated with international partners. The results suggest that scientists respond strategically to research funding restrictions and that modest science policy shifts can have a significant influence on the within‐country composition of research and the pattern of global research collaboration.
