Debates about child custody following parental separation often have been framed in terms of a battle between the competing rights of different family members. In the United States, advocates of mothers’ rights square off against proponents of fathers’ rights, with each side claiming to truly represent children's rights. Of course, not all advocates lay claim to children's rights in contact and custody disputes merely as a tactical maneuver. Some experts believe that children are entitled to (and benefit from) their own, independent legal advocate in custody cases. In theory, at least, the position that children lay claim to a third set of independent rights is strongly held in Europe, more strongly than in many U.S. states, because of the adoption of United Nations Convention on the Rights of the Child in Europe, but not in the United States. In this article, we examine children's rights in custody disputes from a European perspective, particularly children's legal right to contact with their parents, as well as the children's right to be heard in custody and contact disputes. We find that, despite differences in legal theory, tradition, and family demographics, European countries ultimately face a familiar reality: Custody and contact disputes are, in reality, more about renegotiating family relationships than they are a matter of a mother's, father's, or child's rights. 相似文献

This study explains the intellectual history and ideology of the Turkic insurgency and the East Turkestan Republic in Kashgar in 1933–34. Texts in periodicals from the period suggest that the insurgency was defined by its intellectual elites more as a nationalist enterprise than as a religious one. The insurgency's ideologists established important national attributes of the East Turkestani nation, particularly its national name, homeland, symbology, and history, and they also articulated East Turkestani national interests, particularly political independence, representative government, and modernization. Regardless of the arguably low degree of social penetration of the ideas of the elites among common society and the small extent to which policy was actually implemented, the intertwining of East Turkestani national identity and interests with political self-government and modernization was an ideological concept that had a profound impact on all subsequent administrations in Xinjiang. 相似文献

The favourable assessments of international organisations regarding the character of democracy in the Central European countries seem to suggest that, in spite of early fears, democracy can be established even in a low-trust environment. Through analysing the difficulties of fiscal adjustments in Hungary this article examines how lack of trust affects the quality of these democracies in terms of effective governance. Hungary used to be a front-runner in the transition process but given its ballooning budget deficit, it is now considered a laggard in terms of meeting the requirements for introducing the euro. This article claims that while strong continuities from the socialist period gave the country a head start at the beginning of the transition process, the same continuities have slowed down development more recently because of their effects on the general level of trust. The prevalence of distrust both towards and within the elite provides a fertile environment for economic populism and under such circumstances fiscal adjustment becomes more difficult. The main conclusion is that while the low level of trust did not prove decisive in terms of establishing the institutions of democracy, the existence of trust is critical for effective governance. 相似文献

While forensic studies have reported higher than community rates of mental disorders in imprisoned populations, few studies have focused on attention‐deficit/hyperactivity disorder (ADHD) in these subjects. The aim of this study was to investigate ADHD prevalence among young French male prisoners. A specific diagnostic interview (Conners' Adult ADHD Diagnostic Interview for DSM‐IV, CAADID) was used. Correlations between ADHD, subsyndromal ADHD, and criminal features were investigated. 11% of young male prisoners among 93 male subjects aged 18–35 years met the criteria for actual ADHD, and 17% met those for childhood ADHD. Considering ADHD and subsyndromal ADHD, prevalence was about 43% in adulthood. ADHD and subsyndromal ADHD in adulthood were significantly associated with a higher number of imprisonments and a younger age at first arrest. Public support for policy instruments is influenced by perceptions of how benefits and costs are distributed across various groups. We examine different carbon tax designs outlining different ways to distribute tax revenues. Using a national online sample of 1,606 US respondents, we examine support for a $20/ton carbon tax that is: (1) revenue neutral: revenue is returned to citizens via tax cuts; (2) compensation-focused: revenue is directed to helping actors disproportionately hurt by the tax; (3) mitigation-focused: revenue funds projects reducing carbon emissions; and (4) adaptation-focused: revenue is directed to enhancing community resilience to extreme weather events. We find devoting revenue to mitigation raises overall support for carbon tax by 6.3 per cent versus the control (54.9 per cent) where no information on spending is provided. Other frames raise support in specific subgroups only. Revenue neutrality raises support among lower-income households (+6.6 per cent) and political independents (+9.4 per cent), while compensation increases support among lower-income repondents (+6.1 per cent). 相似文献

ABSTRACTThe paper deals with the issue of overpricing of public procurement in low-performing EU countries. It examines a uniquely large sample of public procurement in 11 Central and Eastern European countries. Hierarchical regression is used to analyze the factors that influence public contract. Our results indicate that institutional factors have a greater impact on overpricing than individual decisions by the contracting authority. Our analysis for low-performing EU countries provides interesting results and also draws attention to behavior that is not typical of the better established and more advanced EU countries. Our results are particularly important for public policy in each country, as they show the direction of regulatory action in the field of public procurement. The results introduce a debate on the appropriateness of “one size fits all” regulations within the EU. 相似文献
