In their investigations of criminal cases, law enforcement agencies rely heavily on forensic evidence. Numerous studies have examined the scientific and technological advancements of DNA testing, but little evidence exists on how the availability of DNA evidence influences prosecutors' decisions to move cases forward in the criminal justice system. We created a new database by juxtaposing data from the Forensics Division of the Israel Police, which recorded the presence (or not) of DNA profiles in criminal cases (n = 9862), and data on the indictment decision for each case (2008–2019). Rates of indictments are computed for each case, and trend lines are used to present variations in the rates of indictment decisions with and without DNA profiles. Approximately 15% of all criminal cases without DNA presented to the prosecutor's office are subsequently prosecuted, compared with nearly 55% of cases with DNA profiles. The presence of DNA evidence influences the prosecutor's decision to move a case forward in the criminal justice system. Utilizing a scientific approach to prosecute offenders is a welcome development; however, DNA evidence is not infallible, and caution must be exercised in regard to DNA's overuse in the legal system. 相似文献

The rule of law is a widely used term in scholarship on Ottoman legal reforms. Nevertheless, the actual meaning of this notion is rarely clarified in the writing on the late Ottoman Empire although theorists of law have discussed the ambiguity of this term. This article aims at examining the value of the rule of law as an analytical category when discussing socio-legal change in the late Ottoman Empire. The federal government has a large backlog of office and other space needs. Some policymakers argue that more sharing of courtrooms by federal judges would lower courthouse construction costs and free resources for other purposes. Others worry that sharing of courtrooms would increase trial delays and other costs. Decision makers employ a variety of techniques to better understand and to help guide decisions about issues like courtroom sharing. This analysis applies one such technique to simulate the flow of trials through a federal court system and to assess the impact on trial delays of providing less then one courtroom per judge. The aim of this article is to outline the development of Israel's citizenship and immigration policy from its inception to the present, emphasizing the invaluable role of Israel's first Prime Minister, David Ben Gurion. We argue that through a series of decisions pertaining to civic registration, immigration and naturalization of non-Jews, Ben Gurion set the fundamental principles of modern Jewish nationhood: on the one hand, he rejected the option of establishing a civic-Israeli nation, advocating Jewish-ethnic nationhood instead; on the other hand, this was an inclusive Jewish nationhood which incorporated cultural–territorial elements that were based on a secular interpretation of biblical sources. Despite inserting religious elements into Israel's immigration laws over the years, we claim that Ben Gurion's fundamental principles have for the most part remained in effect until today, constituting the key to understanding the nature of Jewish-Israeli nationhood in our times. 相似文献

The article offers an empirical foundation through which the electoral behaviour of the new Oriental immigrants into Israel during the 1950s can be interpreted, based on the assumption that their conduct was, in fact, rational. It focuses on the egalitarian wage policy in the important public sector, which led Ben-Gurion and the leaders of Israel's first ruling party, MAPAI, to a confrontation with the European academically educated middle class, and on the political–electoral strategy of MAPAI vis-à-vis the Oriental immigrants during the 1950s electoral campaigns. The article discusses three assumptions: first, that this wage policy was part of the ruling party's attempt to address the interests of the new Oriental working class; second, that this political strategy was publicly discussed, and it addressed the Oriental immigrants’ rational socio-economic calculations for the purpose of securing their political and electoral support; third, that the leaders of nascent Israel and its ruling party presented this policy as a measure towards creating a minimal socio-economic foundation for the process of nation-building during the 1950s. 相似文献
