Migration and the reconfiguration of Malaysia

This article examines the social impact of the 1997 financial crisis in South Korea. Although the crisis was short-lived, it has created major ripples all across the country, profoundly affecting the Koreans' lifestyle and family life as well as their values and worldview. In spite of the magnitude of the financial crisis and its social impact, scant scholarly attention has been paid to the issue, although the causes and economic impact of the crisis have been amply discussed. In view of this, the article examines major social changes brought upon by the financial crisis. The article probes, for example, how employment patterns have been deeply affected, whereby a majority of workers are now irregular workers or are underemployed. The article also demonstrates how the people's perception of work has changed and how the income gap between the rich and the poor has widened. Also discussed are, among others, the continuing discrimination against women in the workplace, rising divorce rate, increase in immigration and value conflicts over the relevance of Confucianism in contemporary Korea. In addition, the article examines the agency of the Korean people in reacting to or coping with the changing circumstances.     

论政府应对突发事件防御体系中的能力建设

社会各种突发事件频繁发生,政府在处置这些事件中应处于主导地位,提高政府防御突发事件的能力具有很强的现实性。政府应对突发事件防御体系的能力包括突发事件的预防能力、控制能力和处置能力。建立突发事件防御体系,政府机关需要通过强化处突基础,健全保障能力;强化科学预测,健全预警能力;完善法规体系,健全应对能力;组织实训演练,提高实战能力。     

对逮捕强制措施适用的调查分析

新《刑事诉讼法》在逮捕强制措施方面作了重要的修改,在逮捕必要性方面细化了＂社会危险性＂的五种情形和＂应当逮捕＂的三种情形。逮捕强制措施在司法实践中呈现出整体意识增强与整体效果不佳并存,重法定量刑证据的收集与轻逮捕必要性证据收集的意识并存,重逮捕必要性结论与轻逮捕必要性论证的现象并存,高逮捕率、低瑕疵率与低逮捕率、高瑕疵率的现象并存的特点。分析其产生特点的原因,提出相应的对策建议,有助于完善逮捕强制措施的适用。

法律责任歧见剖析──与李颂银先生商榷

文章批评了“李文”对法律责任的误解,认为：“传统法理学”在法理学界并不具有明确的涵义;法律责任不是一种关系,而是一种实体,以法律责任作为构建法理学的基石范畴也存在诸多理论问题;法律责任的认定和追究权属于法定机构,而不属于其他社会主体。     

中日经济立法与理论研究之比较

中日两国都是当今世界上经济法最为繁盛的国家。两国的经济都经历三个非常相似的阶段,两国的经济法立法相应地分为三个阶段。纵观中日两国经济法立法史,中、日两国都十分重视经济法立法,强调政府对经济发展的主导作用,立法赋予了政府较多市场规制权限,“强政府”形象凸显于市场。但是,二者之间的差异也是十分明显的。中国的经济法学研究在短短的二十年之内经历了模仿、引进阶段,逐步形成了独具特色、成熟的经济法理论体系,流派纷呈。在日本,经济法学界的分歧较小,普遍认为反垄断法是经济法的核心和基本内容。     

妇产科医疗纠纷司法鉴定82例分析

目的研究妇产科医疗纠纷鉴定案件的一般规律及其医疗过失的特点．为法医学鉴定提供理论支持。方法对2002--2008年在华西法医学鉴定中心鉴定的82例妇产科医疗纠纷医疗过失案例进行回顾性分析。结果妇产科医疗纠纷司法鉴定案例逐年增多;发生纠纷的医院以市（区）级与县级医院为多见,发生纠纷的案件中又以分娩和手术者为多见;医疗过失的主要原因为医疗技术缺陷与医疗管理缺陷。结论法医学鉴定时应参照临床医疗规范,考察医师义务履行情况,重点观察有无医疗技术缺陷或管理缺陷。     

诉讼法律规范的规范化与执法规范化建设——加强执法规范化建设的一个新视角

一、执法规范化建设的内涵与途径 执法规范化,即执法活动、执法行为的规范化,其根本目的在于通过规范执法行为,促进严格、公正、文明执法。执法规范化建设,主要是指为规范执法行为、促进执法公正而开展的执法思想建设与执法制度建设。其范围主要涉及人民法院、人民检察院、公安机关、监狱等政法系统的单位、部门的职权诉讼活动和行政执法活动。     

食品召回法律责任研究

三鹿事件中的大范围召回和《食品安全法》中对召回的确认,引发了人们对食品召回的关注。食品召回责任来源于法定义务,具有经济法属性;食品召回义务与食品违约中的后契约义务存在诸多差别,同时食品召回责任不同于瑕疵担保责任和食品侵权损害赔偿责任,是一项独立的经济法责任,不应将其纳入产品责任法的调整范围。     

Cross border North Korean women trafficking and victimization between North Korea and China: An ethnographic case study

This is a case study on the trafficking of North Korean women via the interviewing of women trafficking victims. The study has an explorative nature. Its primary goal is to address the issues of the cross-border trafficking of North Korean women. In doing so, this research will describe the current picture of cross-border North Korean women trafficking operation between North Korea and China. It will uncover the identity and characteristics of traffickers, the identity and characteristics of victims and contributing factors of their victimization, and the cross-border trafficking routes and procedural networks of trafficking operation. The findings of the current study shows that the problem of North Korean women trafficking is worth being paid attention by the international community and that appropriate counter-measures need to be implemented. Also, this study hopes to facilitate more empirical research on this topic.
