Court improvement of foster care and adoption projects:Ncjfcj Survey Report

Officials from 48 states and the District of Columbia in 1994 accepted federal funding from the U.S. Department of Health and Human Services to help improve courts' handling of cases involving child abuse, neglect, foster care and adoption. Through a survey of participating states, members of the National Council of Juvenile and Family Court Judges have been analyzing common themes found in state Court Improvement of Foster Care and Adoption Projects. This article examines key survey results.     

Forensic entomology: application, education and research in Western Australia.

Forensic entomology as a science and a tool for investigation has had slow beginnings in Australia. A number of small animal decomposition trials have been recorded in the literature but mostly from an ecological rather than a forensic entomology perspective. In the last 20 years, a number of more forensically orientated field trials on small pigs and some fly developmental trials in the laboratory have been conducted but lack any replication. The following article was presented at an international seminar to detail the current research in forensic entomology, the applications of forensic entomology in scene of crime (SOC) and homicide investigations and the education of police and judiciary in the discipline of forensic entomology in Western Australia over the last 10 years.     

SUPERVISED ACCESS

This article addresses the question of whether long-term supervised access is an appropriate solution when unsupervised access is unlikely to become possible in the future. The article assesses judicial decisions and theoretical commentary on this issue in light of the opinions and practices of service providers and in light of the best interest of the child standard. The opinions and practices of service providers were gleaned from published materials and from interviews with service providers at supervised access facilities in Vermont and New Hampshire and in Ontario, Canada. The supervised access facilities surveyed for this research were diverse in their practices and experiences but remarkably similar in their approach to long-term supervised access. Outside the scope of the research for this article was the question of whether the opinions and practices of the service providers at the facilities surveyed are representative, and this question requires further investigation .     

Up Against the Wall: Bare Life and Resistance in Australian Immigration Detention

This article is based on interviews with former Australian immigration detainees conducted by the author. The interviews explored the experience and understanding of resistance while in detention. The article calls into question Agamben’s twin conclusions that nothing short of a complete re-founding of ontology is required to liberate humanity from biopower and that this refoundation will spring from bare life. Contrary to Agamben’s depiction, the camp proves to be a place of determined and often successful defence of a relation of politics and life based not on the camp and biopower, but on solidarity and freedom. Detainees in Australian immigration detention, like prisoners in the Nazi concentration camps, refused to abandon their politics. Rather than seeking to transform bare life, they rejected it and made their own decision on life and politics.
