Vertical restraints among hospitals, physicians and health insurers that raise rivals' costs. A case study of Reazin v. Blue Cross and Blue Shield of Kansas, Inc. and Ocean State Physicians Health Plan, Inc. v. Blue Cross and Blue Shield of Rhode Island

Two recent district court opinions consider whether affiliations among hospitals, doctors and health insurers--through contract or ownership--violate the antitrust laws. This Article applies a raising rivals' costs framework to the facts of those cases in order to assess whether the practices at issue were unreasonable.     

African Anarchy: Is it the States, Regimes, or Societies that are Collapsing?

African states have had their functions so weakened that some speak of collapse and anarchy; hence they conflate the collapse of state services with the collapse of a regime and with the collapse of social order. In fact the three are not synonymous. Though the state, defined in institutional terms, may collapse, there are examples that regimes can live on through their retention of juridical status and through the establishment of an informal and parallel state system. Even when all central control evaporates, militia-run structures or more traditional kinship organisations have been found in some circumstances, preventing total social disorder. Surprise that communal organisation exists beyond the state only reveals deep-rooted normative assumptions.     

Community Driven Development and Structural Disadvantage: Interrogating the Social Turn in Development Programming in Indonesia

Community-driven development (CDD) programmes have emerged on a large scale in the Global South following research and policy work regarding social capital, capabilities and empowerment. This paper analyses one of the largest international examples of the ‘social’ turn, examining the effects of the CDD approach in governmental, structural and relational terms. While the CDD approach successfully generated new political rationalities and governmental technologies, the ability of development programming driven by social capital concepts to empower marginalised sections of society remains in question. The ambiguities associated with CDD outcomes indicate the contradictions at the heart of social capital debate.     

The Econtractor? Defining the Esports Employment Relationship

Esports is now a multibillion‐dollar industry that has quickly become one of the most discussed segments of the entertainment industry. There has been a rush to mention esports alongside other more traditional sports like baseball, basketball, football, and hockey, but the comparison may not be apt. Esports leagues are fundamentally different from traditional sports leagues because the competitive games that make up esports are the intellectual property of the game makers. This unique structure results in individualized relationships between the game makers, esports producers, the teams, and the competitors. This article is among the first to examine the legal status of esports competitors. In doing so, we discuss the employment conditions within esports that make them unique. The industry is poised to face significant labor‐related challenges in the near future, so the article also analyzes the labor issues esports competitors and leagues face, and the importance for stakeholders to pay attention to the legal status and working conditions of the competitors.     

Attachment Disorganization and Its Relevance to Sexual Offending

The theoretical nature of attachment disorganization within two separate research traditions, are reviewed. Studies of attachment style related to sexual offending are then critically evaluated, with particular reference to the use of the self-report methodology for studying adult attachment styles. Here, it is argued that these studies may not have taken sufficient account of the disorganized attachment style or used a methodology that was able to adequately capture attachment disorganization. In that attachment disorganization could account for some of the known features of sexual offenders, such as aggression and socioaffective problems. We then suggest that if attachment disorganization is found in some serious sexual offenders this could have implications for treatment. Possible ways of increasing the validity of self-reported attachment style are also discussed within this paper.
