In place of the simple modelling employed in anti-terrorist legal discourse, this article posits an interactive model of the relationship between the state and violent political actors, exploring law's role in both the repression and mobilisation of challengers. Drawing on social movement theory, it hypothesises a process of 'legally implicated mobilisation' which takes account both of law's presence and its partial absence in 'legal grey zones' during violent conflict, and it suggests how law may impact upon key elements of the mobilisation process. The hypothesis is applied to qualitative data from Northern Ireland on violent challengers. The data point to the importance of 'messaging' about law in the state of exception, supporting claims that law can have a 'damping' effect on violent conflict. The relationship between repression and violence is partly symbiotic, and in the global 'war on terror,' prisoner-abuse may have a mobilising effect on violent challengers.  相似文献

The assignment of women guards to security positions in men's prisons in the United States is increasingly a correctional reality. This article considers the problems these women face in entering a previously all-male, “front-line” occupation. The discussion focuses on (1) how well female officers meet the security demands of security work, (2) the nature of, and basis for, difficulties in relating to male co-workers, and (3) occupational socialization and advancement. Drawing on available empirical and anecdotal data on women officers in male prisons and on the more general prison guard literature, the intent is to present what is known about these women officers. A research agenda is offered to guide inquiry into the problems of the sexual integration of correctional institutions.  相似文献

The federal sentencing guidelines prescribe ranges of sentences to be given to persons convicted of felonies in the federal criminal courts. The U.S. Sentencing Commission wrote the guidelines attempting to make sentences conform to community views of appropriate punishments, along with several other criteria. Employing data from a 1994 national sample of adult Americans, designed as a factorial survey, the degree of correspondence is shown between guidelines sentences and those desired by the American public. Although at the individual level only a modest degree of concordance was found, the central tendencies of public opinion (median sentences) were found to correspond quite closely to the guidelines sentences. The major points of disagreement centered around drug trafficking crimes: the guidelines prescribed very long sentences for those crimes and distinguished sharply among trafficking in heroin, powder cocaine, and crack, whereas median sentences desired by the public were much lower and did not distinguish sharply among trafficking in those drugs. We interpret the findings as indicating that the guidelines sentences conform reasonably closely to American normative consensus concerning the sentencing of federal felons.The research reported in this article was commissioned by the U.S. Sentencing Commission. The use of attitudinal surveys has become a widely accepted method for the incorporation of public opinion in public policy decisions. Because of the assumption that the interpretation of such surveys is straightforward and clear, little critical attention has been devoted to the methodological and theoretical problems encountered when translating these findings into public policy. A case in point involves the proliferation of surveys aimed at assessing the mood of the public toward the police. A review of the literature reveals that the research findings about the public mood are contradictory and thus lack convergent validity. The findings of this study indicate that this lack of convergent validity in the images of the public toward the police can be explained on both methodological and theoretical grounds. More specifically, the findings indicate that the mood of the public is very different depending on the level of specificity of the items used to tap that mood. Items eliciting evaluations of a general nature show the public as supportive of the police, while items of a specific nature show much less public support. This apparent paradox is explained through the use of a theoretical framework developed by Easton (1965), which emphasizes diffuse and specific support as external influences on institutions.  相似文献
