企业内争议预防性处理实务

涉及企业之劳资争议处理之机制,其名称会是五花八门,不一而足.遇有任何劳资争议,其预防性处理(preventive dispute resolution)总是优于补救性处理(remedial dispute resolution).企业争议预防性处理,即是当事人自治与自愿,而预防争议扩大之处理机制.企业争议预防性处理机制建立,主要需有一些要件为基础,例如争议双方需互为依赖(interdependence),且必需依赖互相合作以达成其等之目标或满足.企业内预防性调解主要之各工具与技巧面向,含有企业内动态性的争议处理机制、利益基础型问题处理方法、调解人参与之劳资会议、基层监管人员训练与目标性关系制度.

穗港澳青年参与社会团体的比较研究

青年对社会团体的参与状况侧面反映了青年对社会的参与度,根据穗港澳青年参与宗教/教会团体、运动/娱乐团体、教育/艺术/音乐/文化团体、工会、政党团体、专业协会、公益慈善团体、消费者组织八大社会团体的调研实践,发现穗港澳青年最乐于参与运动/娱乐团体、教育/艺术/音乐/文化团体、公益慈善团体,最不愿意参与的是工会、政党团体、消费者组织,且广州青年的团体参与率最高,其次是澳门,最低的是香港青年.青年参与凸显的问题在于尚有相当一部分青年对社会团体冷漠,港澳青年对政治团体颇有隔阂,对宗教团体则过分热衷,原因在于青年参与的大环境不清晰不规范,社会主流价值和个人价值取向差别较大,国家相关部门应该针对穗港澳三地不同环境特征从青年主体、参与目标和路径多维度实施战略以实现异曲同工之妙.     

Research on the Affordable Housing Community: Review and Prospect

The construction of affordable housing is not only housing construction，but also community cultivation. The construction of affordable housing community is one of the key indicators to determine the effectiveness of the housing policy. Based on collecting related literature in CNKI, the researcher conducts a quantitative analysis of the research literature on affordable housing in China by using Bicomb2.0. The study has found that the quantity of research results is closely related to the development of the policy. The research focuses on the housing policy, financing and post management. Community research is marginalized in the research heat maps, and research disciplines are mostly human geography, management and so on. Then the researcher reviews the four core issues in the study of affordable housing community, such as the spatial location and community segregation of affordable housing, the satisfaction and influencing factors of housing community, the neighborhood interaction and social integration of affordable housing community and public service and community governance of security housing community. Finally, the paper provides proposals for future study.     

企业并购中的职工参与机制研究

在企业并购过程中,职工参与机制的有效实施将有助于防止职工权益受到不当损害,降低企业并购成本,消除劳资之间的冲突。我国现行立法规定了职工参与的组织形式和企业对职工的告知义务,但存在职工参与的内涵界定模糊、职工代表机构未发挥实际作用以及法律后果缺失等问题。为完善我国企业并购中的职工参与机制,应当明确雇主对职工的告知义务,规范职工参与企业并购的组织形式及其职能,并完善雇主违反职工参与规则的法律后果。     

正确理解群众路线与社会主义核心价值体系的关系

当前,在中国特色社会主义事业建设中,要提高我国的综合实力,就必须深入开展社会主义核心价值体系的学习和教育,并将群众路线贯彻其中。二者在本质上都是服务人民、联系群众,并且以实现社会主义价值理念为核心;群众路线在社会主义核心价值体系的学习教育和推广过程中得以丰富和发展;践行群众路线与社会主义核心价值体系的建设都是长期的过程,是曲折中前进的过程。

The implementation of Japanese post-war policies towards China has been through a gradually shifting process, chronologically going from policies of anti-China sentiment, friendly cooperation and a combination of caution and cooperation. Under the context of these adjusting policies towards China, the national political environment and the American power of discourse have both significantly affected Japanese authorities. At the same time, common economic interest and caution concerning China’s competitiveness have always been a stable consideration.     

数据驱动时代的数据隐私保护——从个人控制到数据控制者信义义务

在数据驱动时代,个人数据隐私引发广泛的担忧。基于个人具有隐私自我管理能力的假定,立法者建构了一套沿袭传统个人主义隐私观的数据隐私保护法律框架。这种强调个人控制的立法取向高估了个人在数据实践中的自治能力,难以应对数据时代的隐私挑战。可考虑将信义义务引入新型的数据关系之中,要求自动驾驶汽车制造商、其他智能交通服务提供者以及数据驱动的其他商业场景中的数据控制者以数据受托人身份管理或处分其占有的个人数据,强化其数据受托职责,以弥补个人在隐私管理中的能力不足。
