Building metropolitan governance capacity: The case of the Communauté métropolitaine de Montréal

Abstract: This article is about building metropolitan governance capacity. Based on the case study of the Communauté métropolitaine de Montréal (the Montreal Metropolitan Community), the authors seek to understand how this new metropolitan institution develops its capacity to manage metropolitan issues. What factors influence metropolitan governance capacity? What are the impacts of actor behaviour, incentive structures, and political leadership on that capacity? Specifically, results focus on two of the CMM's areas of responsibility: land‐use planning, and social and affordable housing. Based on the analysis of official documents of the CMM (its act of incorporation, activity reports, budget, etc.) and thirteen interviews with elected municipal officials and public servants, the authors show that the building of metropolitan governance capacity is influenced by the interactions between those three factors, as well as by other elements specific to each context.     

Intelligence-led Peacekeeping: The United Nations Stabilization Mission in Haiti (MINUSTAH), 2006–07

In the slums of Haiti, where pistol and machete wielding gangs dominated the populace through murder, intimidation, extortion, and terror, a UN peacekeeping mission managed to established law, order, and government control. The United Nations Mission for the Stabilization of Haiti (MINUSTAH) succeeded by ‘taking on’ the gangs in a series of military and police ‘search and arrest’ operations in 2006–07. The achievement was made possible by thorough ‘intelligence preparation of the environment’. This paper tells the story of the ‘intelligence-led’ military–police–civil operations and how they transformed the Haitian slum of Cité Soleil from a foreboding place inaccessible to police for years to one in which the UN workers could safely walk its streets. The functions, structures, problems and challenges of the mission's intelligence capability are described, especially the work of the Joint Mission Analysis Centre (JMAC). Human intelligence proved to be key, while technologies helped considerably. Within the United Nations, intelligence remains a controversial and sensitive matter but the Haiti mission provides a valuable model of how to gather and use actionable intelligence.     

Bio-Kraftstoff, Nachhaltigkeit, Boden- und Naturschutz

Um ihr Klimapaket und die damit verbundenen Ziele im Bereich der erneuerbaren Energien umzusetzen, hat die Europ?ische Kommission eine Richtlinie zur F?rderung der Nutzung von Energie aus erneuerbaren Quellen vorgeschlagen. Um den Richtlinienentwurf rankt sich – auch noch zur Zeit – eine breite noch nicht abgeschlossene Diskussion, in deren Rahmen unter anderem Bedenken gegen die F?rderung von Energiepflanzen, die als nachhaltig deklariert wird, ge?u?ert werden, da blühende Kulturlandschaften dadurch verschandelt werden. Der Beitrag besch?ftigt sich mit der politischen und rechtlichen Diskussion des Richtlinien-Entwurfs.     

Die Zugriffsverbote des § 42 Abs. 1 BNatSchG im Zulassungs- und Bauleitplanverfahren – unter Berücksichtigung der Entscheidung des BVerwG zur Ortsumgehung Bad Oeynhausen (in diesem Heft)

Zusammenfassung  Artenschutzrechtliche Regelungen schieben sich in verwaltungsrechtlichen Zulassungsverfahren immer mehr in den Vordergrund und erweisen sich als ein ?u?erst schwieriger Problemkreis. Teilweise scheint der Artenschutz inzwischen der Kernpunkt der naturschutzrechtlichen Beurteilung zu werden, wobei die Reichweite der Tatbestandsmerkmale nicht immer beachtet wird. Die nachfolgende Ausführungen sollen dazu beitragen, den Anwendungsbereich der artenschutzrechtlichen Verbote nach § 42 Abs. 1 BNatSchG zu konturieren und deren Umfang der gesetzlichen Einschr?nkungen zu erl?utern. Die Entscheidung des BVerwG zur Ortsumgehung Bad Oeynhausen wurde berücksichtigt.
