In this essay I defend the idea that the mexican legal order has been partially constitutionalized since the amendment to the first article of the Constitution in june 2011. I argue that some conditions of a constitutionalized legal system can be found in this rule. An analysis of those conditions is carried out through the work and in the end I discuss the matter of whether this constitutional change amounts to a new legal paradigm.  相似文献

This study analyses the factors that influence citizens' intention to use e-government activities offered by municipalities in Spain. For this purpose, we developed a straightforward user behaviour model that considers the components of the TAM and DOI models simultaneously, harnessing their synergies and factoring in the role of citizens' trust. We also examined the moderating role that population size can play in the model's behaviour. Among the results we obtained, it is important to note that user trust not only improved the model's fit, but also showed a significant effect on intention of use for all the population sizes that we analysed. The other significant relationship for all the samples linked ease of use to perceived usefulness. For the other relationships between variables, we observed the moderating role of size for the populations we considered.  相似文献

ABSTRACT

Timor-Leste chose semi-presidentialism as its government system to steer the country towards a democratic state. This government system became popular in the course of the ‘Third Wave’ of democratization, but has no other example in Southeast Asia. The Timorese Constituent Assembly was guided not by an appraisal of the virtues and pitfalls of competing systems, but by historical and political factors that led it to craft an institutional solution in line with significant features of Timorese society. Yet the specific form of semi-presidentialism adopted in Timor-Leste (‘president-parliamentarism’) is regarded in the literature as prone to instability. However, in spite of episodes of instability, the conclusion emerging from three consecutive presidencies is one of positive steps in democracy-building and consolidation. This is mainly due to the emergence of ‘independent’ presidents who have sought power-sharing arrangements and promoted inclusive governance.  相似文献

While academics have addressed the interaction between mobilisation and citizenship in a myriad of ways, none of them have used citizenship to explain the sustainability of collective action. Drawing on an ethnographic fieldwork in Santiago de Chile’s underprivileged neighbourhoods, this paper provides an analytical framework explaining how neighbourhood activists sustain mobilisation on the basis of citizenship construction despite Chile’s transitional and post-transitional stark political exclusion. This article calls this concept ‘mobilisational citizenship’. Building on the notion of rights-claiming, mobilisational citizenship explains how durable mobilisation results from the dynamic interaction between four factors: agentic memory, mobilising belonging, mobilising boundaries and decentralised protagonism. Through mobilisational citizenship, local residents politicise their neighbourhood, build autonomous local empowerment and self-define their political incorporation.  相似文献

This article approaches the Brazilian military involvement in the United Nations Stabilization Mission in Haiti and the pacification programme undertaken in Rio de Janeiro favelas under the name of ‘Pacifying Police Units’ (Unidades de Polícia Pacificadora) in order to understand the forms through which a specific security–development nexus is mobilised in those security practices, as well as the policies and priorities which are legitimated by such mobilisations. It is argued that these engagements are marked by a conception of such nexus in which the first element, security, is constructed as the production of public order; and the second one, development, is constantly postponed as a goal, in spite of official discourses which construct it as a priority in Brazilian internal and external engagements. The analysis of these practices may shed light on some of the possible mobilisations of security and development in future Brazilian engagements at home and abroad, especially in the context of the proliferation of UN stabilisation missions.  相似文献

In governments throughout the world, bank lending excesses, solvency issues and worsening credit ratings have all contributed to raising risk premiums and impeding access to credit, thus provoking a major financial problem in the public sector. Accordingly, tax authorities and regulators need to analyse the causes of public sector bank debt, doing so through the joint study of idiosyncratic and systematic variables, an area that has been neglected in previous research. This paper examines idiosyncratic and systematic factors that may influence local government credit risk through an empirical study of the performance of 148 large Spanish municipalities during 2006–2011. We identify individual factors relevant to the probability of local government default (such as dependent population, per capita income and debt composition) and also determinants associated with macroeconomic developments, such as gross domestic product and the risk premium.  相似文献

What is the role of friends in practices of care within intimate relationships, either towards each other, or in supporting caring practices towards other persons (children, parents or other kin)? And to what extent are these caring practices gendered? I explore how friendship either disrupts, or reproduces, the ethics of care that cross-cuts gender relations throughout society. I focus on the experience of Portuguese men and women and take as reference their personal community, understood as the active and meaningful personal ties they consider to be central in their lives. Drawing on qualitative data from 30 in-depth interviews, I explore their experiences of care in three dimensions: caring for others; caring for oneself; and being cared for. Results show that, while it is not possible to assert a complete centring of personal lives on friendship, friends stand out as important sources of care in these three different situations, providing both emotional and practical support.  相似文献

Limited research has been done on non-governmental organisation (NGO) heterogeneity and its representation in global governance. Using the example of international climate change politics, we demonstrate that Northern and Southern NGOs tend to pursue different perspectives which are very unevenly represented in international climate change negotiations as NGOs from the Global North still constitute the large majority of NGOs taking part in these negotiations. In contrast to more hopeful outlooks, NGOs, hence, do not automatically contribute to a more democratic and legitimate global governance.  相似文献
