Postmortem red coloration of teeth. A retrospective investigation of 26 cases

Postmortem red coloration of teeth (pink teeth) was found in 26 of 119 consecutive autopsy or forensic dental identification cases during 1973-1984. The present study confirms that red coloration of teeth may occur some time after death under conditions that promote putrefaction and adipocere formation. The red coloration is due to hemolysis after exudation of hemoglobin derivatives through the dentine tubules in cases in which blood has accumulated in the head, either due to congestion or by a postmortem head-down position, as after submersion in water.

Clustering of Multilateral Environmental Agreements: Potentials and Limitations

The concept of clustering of multilateral environmental agreements (MEAs), i.e. the integration of groups of MEAs or parts thereof, has acquired prominence in recent discussions about reforming international environmental governance. Understood as a continuing process, clustering of MEAs aims at advancing the ongoing process of integrating the elements of this system more systematically and dynamically. This paper proceeds in three steps. First, it demonstrates that a distinction needs to be made between clustering of organisational elements of MEAs and their functions, since the conditions and the effects of their integration differ significantly. Second, it argues that – in contrast to several existing approaches that seek to build clusters starting from similarities in one dimension – any attempt to integrate elements of MEAs needs to be based upon the analysis of a range of factors that influence the prospects of such integration (including overlap of membership and issues, practical feasibility, legal obstacles, and functional requirements). Third, the article contrasts the main potential benefits of a clustering of MEAs, namely efficiency gains and an increase in the coherence of international environmental governance, with the main challenges of international environmental policy, namely reaching agreement, implementing such agreement effectively and preventing/managing inter-institutional conflict. While clustering cannot be expected to make a significant direct contribution to addressing these challenges, it has a potential to economise and enhance the system of international environmental governance with positive indirect effects promoting better international environmental protection in the longer term.     

Limited Liability and Imperfect Information—On the Existence of Safety Equilibria Under Products Liability Law

In the literature on the economics of tort law the Cournot-Nash equilibrium concept has been undisputed. In particular, the existence of a Cournot-Nash safety equilibrium has been taken for granted, given the usual convexity assumptions. In this paper a simple model of strict liability with the defence of contributory negligence is considered. Liability is assumed to be limited. It is shown that for a certain range of liability limits no Cournot-Nash safety equilibrium in pure strategies exists. A mixed strategy equilibrium exists but it turns out to be suboptimal.     

Das System des deutschen Artenschutzrechts und die Auswirkungen der Caretta-Entscheidung des EuGH auf den Absichtsbegriff des § 43 Abs. 4 BNatSchG

Das Artenschutzrecht ist eine ausdifferenzierte, völker-, europa- und nationalrechtlich geprägte Rechtsmaterie. Ausgangspunkte einer Prüfung sind Schutzstatus der Art und die Handlung, die vorgenommen werden soll. Bei Eingriffen in besonders geschützte Arten durch Land-, Forst- oder Fischereiwirtschaft sowie durch zugelassene Eingriffe ist § 43 Abs. 4 BNatSchG eine Schlüsselnorm, die absichtliches Handeln voraussetzt. Absichtlich sind gezielte Beeinträchtigungen von Tieren und Pflanzen, nicht absichtlich sind Beeinträchtigungen, die sich als unausweichliche Konsequenz rechtmäßigen Handelns ergeben. An dieser Auslegung hat sich durch die Caretta-Entscheidung des EuGH nichts geändert.

Migrantennetzwerke im Zeitverlauf — Junge russische Juden in Berlin

Soziale Beziehungen zu Einheimischen gelten in der Migrationssoziologie als eine zentrale Dimension des Akkulturationsprozesses. Auf der Basis einer Langzeitstudie über junge russisch-jüdische Migranten wird die Entwicklung sozialer Beziehungen zu Deutschen über drei Befragungszeitpunkte verfolgt. Dazu wurden aus Leitfadeninterviews Handlungsstrategien (Integration, Separation, Assimilation, Marginalität) rekonstruiert und unabhängig davon die Anzahl deutscher Netzwerkmitglieder mittels eines Network Questionnaire erhoben. Im Ergebnis zeigt sich erstens ein enger Zusammenhang zwischen Handlungsstrategien und der Anzahl tatsächlich genannter Netzwerkmitglieder. Zweitens wird deutlich, dass über die Hälfte der Migranten bei einer einmal eingeschlagenen Handlungsstrategie geblieben sind, während die anderen mehrheitlich von Separation zu Integration gewechselt haben. Hieraus folgt, dass zur Beschreibung von Akkulturationsprozessen eine Kategorisierung nach Handlungsstrategien sich nur dann empfiehlt, wenn mehrere Befragungszeitpunkte gegeben sind.     

Racial targeting and social control: looking behind the police

The experience, common among minority ethnic populations, that they are racially targeted has typically been laid at the door of the police whose coercive practices and whose ‘institutionally racist’ culture have been blamed for this state of affairs. While police practice remains an issue, it is my contention that by focusing on police practice alone critical commentators can loose sight of the extent to which racial targeting is an outcome of the regimes of control integral to the wider governance of crime in the neo liberal state. By examining the implications of anti-terror legislation, by attending to the way centres of consumption in the entrepreneurial city are regulated and by looking at how problems of serial exclusion experienced by migrant populations in Britain’s poorest areas are managed, this paper examines how perceptions of racial targeting will continue to be reproduced independently of getting the police to change their practices.
