This article discusses recent trends to incorporate the results of systematic research (or ‘evidence’) into policy development, program evaluation and program improvement. This process is consistent with the New Public Management (NPM) emphasis on efficiency and effectiveness. Analysis of evidence helps to answer the questions ‘what works? and ‘what happens if we change these settings?’ Secondly, some of the well known challenges and limitations for ‘evidence‐based’ policy are outlined. Policy decisions emerge from politics, judgement and debate, rather than being deduced from empirical analysis. Policy debate and analysis involves an interplay between facts, norms and desired actions, in which ‘evidence’ is diverse and contestable. Thirdly, the article outlines a distinction between technical and negotiated approaches to problem‐solving. The latter is a prominent feature of policy domains rich in ‘network’ approaches, partnering and community engagement. Networks and partnerships bring to the negotiation table a diversity of stakeholder ‘evidence’, ie, relevant information, interpretations and priorities. Finally, it is suggested that three types of evidence/perspective are especially relevant in the modern era – systematic (‘scientific’) research, program management experience (‘practice’), and political judgement. What works for program clients is intrinsically connected to what works for managers and for political leaders. Thus, the practical craft of policy development and adjustment involves ‘weaving’ strands of information and values as seen through the lens of these three key stakeholder groups. There is not one evidence‐base but several bases. These disparate bodies of knowledge become multiple sets of evidence that inform and influence policy rather than determine it.  相似文献

Mock jurors' use of probabilistic evidence was examined in a fractional factorial design manipulating 7 variables: strength of nonstatistical evidence; quantification of nonstatistical evidence; strength of statistical evidence; combination of 2 pieces of statistical evidence; instruction in use of Bayes' theorem; and presentation of fallacies (both prosecutor's and defense attorney's) concerning use of statistical evidence. One hundred eighty-nine subjects viewed 1 of 16 videotapes presenting a condensed mock trial. Subjects completed dependent measures after each of 4 witnesses and at the end of trial. The strength of both nonstatistical and probabilistic evidence affected verdicts; the other manipulations did not. Overall, subjects slightly underused the probabilistic evidence, as compared to their individualized Bayesian norms, and subjects did not succumb to fallacies. However, subjects greatly varied in over-or underutilization, even after Bayesian instruction. Future research should examine use of weak nonstatistical evidence, and should test different probabilistic instructions.  相似文献

From 1940 to the present, the on-the-record consensus among Supreme Court justices fell precipitously relative to historical benchmarks. This paper first shows that Court consensus is closely associated with measures of consistency and stability of Court rulings. Then, an empirical model of Supreme Court consensus and dissension is estimated over 1800–2001 in which characteristics of the presidential–senatorial screen are key variables. Using OLS and controlling for several other influences, the results show that variations in consensus are linked to two components of the selection screen – the party of the confirming Senate and split party nominations and confirmations. Other than the selection screen, the size of the federal judiciary and consensus norms in the recent past are important influences. These results are also confirmed using GARCH and regime-shifting econometric methods.  相似文献

Abstract: The collective labour law of the European Union is embedded in a variety of legal measures incorporating principles of collective labour law reflecting national experience. The dynamic of its development has been the spill-over effect of these principles, through their translation into the status of EU law, and their development by decisions of the European Court of Justice. The article outlines a framework of principles which, it is argued, are currently embodied in the collective labour law of the EU. They include collectively bargained labour standards, workers' collective representation, workers' participation, and protection of strikers against dismissal. In addition, there is a parallel principle of collective solidarity emerging in the social security law of the EU. The principle of collective negotiation of labour law introduced by the Protocol and Agreement on Social Policy may be seen as the founding constitutional basis for the collective labour law of the European Union.  相似文献
