Oxaliplatin: a 'basic' patent problem

In an application for a declaration of non-infringement withrespect to a patent claiming a method of preparation for a drug,a claim specifying that the pH is adjusted to be between 3.0and 6.0 by adding an alkali solution required a distinct additionof alkali and was not infringed by use of a reagent that yieldeda pH within the specified range without the need for separateaddition of alkali.     

Perceived Support and Internalizing Symptoms in African American Adolescents: Self-Esteem and Ethnic Identity as Mediators

Existing research leaves a gap in explaining why African American adolescents do not exhibit more anxiety and depression than other youth, at the same time that they experience more contextual risk factors. The current study examined the roles of social support as well as possible mediators self-esteem and ethnic identity (sense of belonging to one’s ethnic group) in reducing internalizing symptoms in 227 African American adolescents (mean age = 12.55). Structural equation models indicated that self-esteem and ethnic identity partially mediated the relation between social support and depression. For depression, ethnic identity accounted for more of the social support effect for males, whereas self-esteem had more impact for females. The mediation model for anxiety was supported in females, with self-esteem more important than ethnic identity. The results suggest that ethnic identity and self-esteem function as important links in how social support reduces internalizing symptoms in African American youth. THE "NEW ADMINISTRATIVE LAW": SOME ASSUMPTIONS AND QUESTIONS

Abstract: Sweeping changes in administrative review legislation and procedures have occurred in Australian Federal government very quickly and with little debate. There have been several assumptions underlying the proposals for administrative law reform, including the notions that government has expanded greatly, that it has intruded into citizens' lives, that it is scarcely restrained by parliament, and that the specialist administrative tribunals established at various times are only partly effective. While these assumptions are all correct in certain respects, they do not necessarily support the demands for administrative law reform in the manner and to the extent that has generally been proposed. Closer examination of these assumptions suggests that comprehensive administrative review might itself lead to further expansion of government; that political decisions will have to be made about degrees of intrusion by government; that political avenues for redress of grievances should not be ignored, and could possibly be developed further; and that the need to prevent administrative errors is at least as great as the need to correct them after they have occurred. There is a good case for comprehensive administration review, but it needs to be examined more closely so that future problems can be anticipated and avoided.
