Gaines and Taagepera [(2013) How to operationalize two-partyness. Journal of Elections Public Opinion and Parties, 23(4), pp. 387–404] propose two indices of two-party competition for district-level data, both of which are alleged to be flawed. The case against them rests mainly on whether or not elections with one dominant party should be regarded as exhibiting one- or two-way competition. For those inclined to see 90–10% and 50–50% outcomes are different in kind, our indices can provide better measures than the popular effective number of parties or the “gap”. We agree that assessment of a set of outcomes, in a given election or over time, requires careful attention to the important distinction between micro-level data and aggregate measures.  相似文献

The pure “best interests” approach to relocation law is a failure. It is unpredictable and expensive, increasing conflict and discouraging settlement. The “fundamental questions” proposed by Parkinson and Cashmore in their article will not reform the law. Real reform will require the use of presumptions or burdens to guide best interests. “Presumptions” are not “rules,” but only starting points. No simple presumption “for” or “against” all relocations can be justified, but there are large categories of cases that do warrant presumptions: interim moves, unilateral relocations, shared care, and predominant primary caregivers. The first three involve presumptions against relocation, while the last—the largest category—warrants a presumption that relocation is in the best interests of the child, unless the contrary is proved. There will remain a small minority of in‐between cases where none of these presumptions will operate, recognizing the limits of our general knowledge. It is time to move the relocation reform debate beyond pure “best interests,” to the next stage, to a serious discussion of which cases warrant presumptions, and of what strength.

The hundredth anniversary of the original publication of Eugen Ehrlich's Fundamental Principles of the Sociology of Law is nearly upon us. The book earned high praise from Oliver Wendell Holmes, Roscoe Pound, and Karl Llewellyn as one of the outstanding works of its time. Ehrlich has been identified as an early legal realist, a pioneering figure in legal sociology, and a leading theorist of legal pluralism. In this retrospective review, I explain the strengths and weaknesses of this classic book. Ehrlich articulated an unsurpassed account of dynamic social‐legal change, an account that remains fresh and timely today.  相似文献

This study offers the first research data on the interest of divorcing parents in marital reconciliation. A sample of 2,484 divorcing parents was surveyed after taking required parenting classes. They were asked about whether they believed their marriage could still be saved with hard work, and about their interest in reconciliation services. About 1 in 4 individual parents indicated some belief that their marriage could still be saved, and in about 1 in 9 matched couples both partners did. As for interest in reconciliation services, about 3 in 10 individuals indicated potential interest. In a sub‐sample of 329 matched couples, about 1 in 3 couples had one partner interested but not the other, and in 1 in 10 couples both partners were interested in reconciliation services. Findings were consistent across most demographic and marital factors. The only strong predictors of reconciliation interest were gender, with males being more interested than females, and initiator status, with far greater interest among those whose partner initiated the divorce. These findings are discussed in terms of attachment theory and future prospects of divorce services.  相似文献
