Multilateral (many-party) negotiations are much more complex than traditional two-party negotiations. In this article, we explore a model of social network activity, especially clique formation, among parties engaged in multilateral negotiation and the implications that such networks might have on the negotiation process and outcome. Using data collected from 375 subjects participating in a negotiation simulation, our results reveal that, primarily, the negotiator's perspectives of clique formation (coalition building) — both his or her own and the other party's — have unique effects on the integrative, problem-solving approaches used in the process and on the negotiator's satisfaction with outcomes. Secondarily, centrality (manifest as emergent power) has a positive effect on both problem solving and satisfaction. Interestingly, we found that those players who emerged as the most dominant and powerful were not as satisfied (in relative levels) as those who were less powerful. 相似文献

- Active citizen participation is increasingly being recognized as essential to effective public policymaking. A key challenge for public administrators is how to effectively engage constituents' diverse viewpoints in sound deliberation that will likely result in coherent, agreed judgments. This paper investigates one such public deliberation process, Australia's first Citizens' Parliament, which brought together 150 randomly sampled Australian citizens charged with the task of formulating concrete policy proposals to be considered by the Federal government. One unexpected outcome of this initiative, especially given Australian ambivalence about nationalism, was the emergence of a shared identity among participants that appeared to bridge cultural and geographical divides. We explore linkages between salient elements of the deliberative process, the emergence of a sense of ‘being Australian’, and the final agreed list of policy recommendations that indicated an understanding of and commitment to the ‘common good’. If the emergence of a shared identity is acknowledged as a key to the development of a coherent public voice, then further examination of these linkages will be critical to the efficacy of future public deliberations. Moreover, given the heterogeneous nature of the Australian electorate and the challenges inherent in the country's federal governance structure, the findings have significant implications for policymakers in similar constituencies, notably the EU and the USA.

This paper explores the role and process of facilitation in restorative justice (RJ). Drawing from a victim offender conferencing program used after serious crime in New South Wales Australia, 84 interviews with restorative facilitators were thematically analysed. The skills, techniques and strategies used to prepare, conduct and de-brief cases are considered including managing complex cases where participants present with intense anger and grief, poor insight into offending and cognitive and mental health issues. While good facilitation is in part the result of knowledge, training and experience, the art of great facilitation relates to the interplay of the facilitator’s inherent characteristics, capacities and world-views alongside this knowledge, skill and experience. While facilitating well is premised on an appreciation of the alchemy that exists within RJ, advanced facilitators use the alchemy to shape the process. Good practice is further enabled through workplace structures that support a team approach where there is open deliberation around needs, risk and harm. Because good facilitation is paramount to the best practice of RJ this paper has implications for current policy debates concerning RJ standards and the training and accreditation of RJ practitioners. 相似文献

There is an emerging view that the term “high conflict” oversimplifies the nature of destructive family dynamics, especially with respect to the small but resource‐intensive group of separated parents who remain deeply enmeshed in legal battles and parental acrimony. In this Article we propose that interparental hatred may be a key relationship dynamic driving the behavior of some in this group. We suggest a distinction between two types of interparental hatred: one that arises from responses to separation‐related stresses (reactive hatred) and the other (entrenched hatred) that is indicative of more embedded, dysfunctional interpersonal dynamics and/or personality structures. While reactive hatred is typically time limited and amenable to professional intervention, entrenched hatred tends to overwhelm rationally informed attempts to mediate, negotiate, or even adhere to orders regarding suitable parenting arrangements. We contend that while effective intervention in these cases requires all the generic skills and responses necessary for dealing with highly conflicted disputes, it is also important to name and appropriately challenge interparental hatred when it is detected. 相似文献

“Bullet wipe” is the material deposited by a bullet on any surface with which it comes into contact after it is fired and may contain debris from the gun barrel, including particles of primer and metal fragments from previously fired bullets. X‐ray analysis is a non‐destructive method by which traces of metallic elements can be visually detected. The analysis of osseous defects for radiodense bullet wipe (RBW) assists in determining the presence or absence of perforating gunshot wounds, especially in fragmented, skeletonized remains. The aim of our current study was to determine the frequency of RBW around entrance firearms injuries that perforated bone. We prospectively analyzed entrance gunshot wounds for RBW over a three‐year period using digital X‐ray analysis (n = 59). We retrospectively reviewed the corresponding autopsy reports to determine the frequency of RBW by biologic sex, reported ancestry, age‐at‐death, location of wound, manner of death, range of fire, bullet caliber, and presence of bullet jacket. Data were analyzed by Fisher's exact test or Chi‐square test with significance levels accepted at p < 0.05. RBW was present in 66% (n = 39) of examined cases. Decedent characteristics did not significantly alter RBW distribution, including biologic sex (p = 0.75), reported ancestry (p = 0.49), and age‐at‐death (p = 0.43). Additionally, the location of the osseous entrance gunshot wound, manner of death, range of fire, and cartridge caliber did not affect RBW detection. All cases involving non‐jacketed rounds (n = 5) showed RBW (p = 0.30). To our knowledge, this study is the first to report the frequency of RBW detection from osseous entrance gunshot wounds. 相似文献

One prominent method for controlling health costs is to find measures for the management of demand. Various options exist for this; and many of them have been tried during the fifty years of the UK's National Health Service. Current policy now focuses on what may be called “scientific‐bureaucratic medicine.” This policy is based on the assumptions that valid medical knowledge is derived from accumulated research evidence and that such knowledge should be implemented through clinical guidelines which are enforced to some extent. This UK development has parallels with the US Agency for Health Care Policy and Research whose experience, therefore, raises some policy issues for the UK. 相似文献

Research dealing with the nexus of collective action, political participation, and digital media confronts three challenges: conceptualizing digital media as an influence on human behavior, finding common ground among new theories, and connecting together individual-level models with structural-level theories. This article addresses these challenges as a theoretical undertaking. It argues that the digital media environment should be understood as a change in the context for action rather than as an individual-level variable, and that this changed context is relevant to behavior because it expands opportunities for action. This expansion involves a range of structural possibilities for viable collective action that entail at least three paths: organizational prompts, social prompts, and self-initiation. There are theoretical reasons to expect that individual-level attributes including age, education, ideology, and personality may differentially affect people’s susceptibility to these prompts. Future research may profit from refinements to behavioral models that account for possible differences across structurally different prompts for action. 相似文献

Sunshine laws establishing government transparency are ubiquitous in the United States; however, the intended degree of openness is often unclear or unrealized. Although researchers have identified characteristics of government organizations or officials that affect the fulfillment of public records requests, they have not considered the influence that government organizations have on one another. This picture of independently acting organizations does not accord with the literature on diffusion in public policy and administration. This article presents a field experiment testing whether a county government's fulfillment of a public records request is influenced by the knowledge that its peers have already complied. The authors propose that knowledge of peer compliance should induce competitive pressures to comply and resolve legal ambiguity in favor of compliance. Findings indicate peer conformity affects both in the time to initial response and in the rate of complete request fulfillment. 相似文献
