《中华人民共和国仲裁法》修改暨中国仲裁协会章程起草研究工作座谈会综述

国务院法制办于2006年4月18~20日在厦门主持召开了《仲裁法》修改暨中国仲裁协会章程起草研究工作座谈会。出席会议的有国务院法制办领导以及全国十几家仲裁机构的主要负责人等。与会代表围绕此次会议的两个主要议题积极发言,献计献策,最终形成了一个面向全国仲裁机构征求意见的《仲裁法》修改草案,并且初步完成了中国仲裁协会章程的起草工作,为进一步征求各方意见并最终成立协会做好了准备。     

非概念性法学中的事实、价值与行为

作为大多数法学理论著述的一种范式 ,非概念性法学涵盖了十分丰富的内容 ,其目标 ,就是要陈述那些经得住反驳的、有知识旨趣的问题 ,以及法律及其后果的社会作用问题。所以 ,非概念性法学理论都是可证伪的。法学对话 (Legaldialogue)则为检测非概念性法学理论提供了至关重要的途径。因而所有的主张 (无论是明确的主张还是隐含的主张 )都是法学对话参与者试图表达其不同观点的手段 ,而他们所要表达的这些截然不同的观点 ,莫过于以下三大类 ,即 :事实、价值与行为

对违纪警察适用禁闭措施的制度评析

《公安机关实施停止执行职务和禁闭措施的规定》从法律上确立了对警察适用禁闭措施的合法性。警察禁闭是警察内部对于有严重违纪行为的人民警察所采取的行政措施,无论是对于警察自身素质的提升还是对整个警察队伍建设都有着积极意义。目前,我国对于该规定的具体实施仍存在不足,需尽快加以完善。一是要从法律层面完善警察适用禁闭措施的规定;二是要有效开展禁闭措施中的警务督察工作;三是要对适用禁闭措施的警察建立心理疏导制度。
