Zusammenfassung  Nachdem die “Kleine Novelle” des Bundesnaturschutzgesetzes für Unsicherheit bei der Anwendung der neuen Reglungen gesorgt hat, enthalten die ersten Entscheidungen der h?chstrichterlichen Rechtsprechung eine hohe aktuelle Brisanz. Der Beitrag geht auf die aktuelle Rechtsprechung des BVerwG zum Artenschutz bei Infrastrukturvorhaben unter dem Aspekt des Gemeinschaftsrechts ein. Behandelt werden die Einschr?nkung des St?rungsverbots, “vorgezogene Ausgleichsma?nahmen”, die Prüfung des Ausnahmetatbestands nach vollendeten Tatsachen, die Zulassung von Ausnahmen bei ungünstigem Erhaltungszustand der Art, das Auseinanderfallen von Entscheidungs- und Beurteilungszeitpunkt sowie die Berücksichtigung von Kosten bei Alternativen.  相似文献

Policy makers of various countries are exposed to critiques that call for the consideration of issues that transcend human, animal, and environmental safety concerns when assessing agricultural biotechnology products. While some jurisdictions have decided to broaden the scope of their approval process for genetically modified (GM) foods, this paper analyzes legal, political, and economic factors that can influence the transfer of these initiatives. Drawing on mechanisms presented in the policy transfer literature, this article examines their mixed effects pertaining to the regulation of biotechnology. Although the mechanisms of competition and coercion do not preclude such a possibility, one must admit that they do not create any incentives for policy makers to include nonsafety criteria within biotechnology regulations. By contrast, to varying degrees, the mechanisms of mimicry and learning can foster the transfer of such a broadened scope that allows a better assessment of GM foods' social acceptability.  相似文献

Primary breast lymphoma is a rare form of extranodal lymphoma. B cells constitute the most common type involving the breast. T cells represents only 3%. Even though lymphomas have a high predilection to metastasize to the heart, there are no specific clinical or radiological findings, and most of the cases are diagnosed at autopsy. We discuss the case of a 49-year-old woman with primary breast lymphoma who presented with sudden death. Autopsy revealed a primary T-cell lymphoma of the breast with tumoral infiltration of the atrioventricular node and transmural myocardial permeation with focal necrosis.  相似文献

Because of the adverse effects that diagenesis exert on ancient skeletal remains, DNA from these samples is often compromised to the point where genetic typing can be challenging. Nevertheless, robust and reliable methods are currently available to allow successful genotyping of ancient specimens. Here we report nuclear DNA-based methods and typing strategies used to analyze 2 human skeletons from a medieval burial. Reliable DNA nuclear profiles were obtained from teeth, whereas mitochondrial DNA analyses in bones were inconclusive. A complete nuclear mini short tandem repeat profile was obtained from a well-preserved premolar, but only a partial one from the femur. Increasing the sensitivity of the polymerase chain reaction system allowed a full profile from the latter, but the presence of artifacts reinforced the idea that the interpretation of this kind of analysis must be performed with caution. The results presented here also indicate that DNA from dental pieces can be better preserved than from bones, even in the case of well-preserved long bones with thick cortical tissue such as the femurs, and have a better chance of successful genetic typing, probably because of the high degree of protection conferred to the DNA by the enamel.  相似文献

Nowadays, as a consequence of scientific advances in embryology, genetics and assisted reproduction techniques, the scientific community ask for new laws to establish new parameters to use with these recent discoveries. Discoveries that have changed the legal concept of "person". In many countries this concept is absolutely useless when facing new techniques such as cloning, stem cell research and embryo storage. This article aims to reconstruct the social imaginaries of Coronavirus disease 2019 (COVID-19) in Chile. We seek to understand how families interpret their experience confronting the pandemic by identifying four main aspects: (a) the COVID-19 pandemic, (b) working and learning, (c) health and (d) family life. Following Habermas' distinction between lifeworld and social systems, we consider these issues as constituting the social imaginary of lifeworld, different but related to the imaginaries of social systems. The qualitative empirical data was gathered through a sample of 38 families interviewed online between September 2020 and January 2021 in four Chilean cities: Iquique, Valparaíso, Santiago and Concepción. Other complementary sources of information are multimodal ethnography (digital diaries), press articles and state reports.  相似文献
