District Judges and Possession Proceedings

In this article, we draw on data obtained in interviews with District Judges about the factors which they say influence the exercise of their discretion in possession proceedings. Analysing the data set enabled us to create three ideal types of judicial decision—making which we have labelled 'liberal', 'patrician', and formalist'. We discuss the differences between each ideal type across five different variables: the District Judge role; approach; view of occupiers; the problem; behaviour of occupiers. Our data demonstrate a set of reasons to explain different approaches and outcomes between different District Judges (as well as the perhaps unlikely identification of a 'maverick' or 'idiosyncratic' style of judging). We conclude by suggesting on the basis of our data that, despite calls to structure or remove the discretion from District Judges, any such changes are unlikely to have much effect.     

Political institutions and debt crises

This paper shows that political institutions matter in explaining defaults on external and domestic debt obligations. We explore a large number of political and macroeconomic variables using a non-parametric technique to predict safety from default. The advantage of this technique is that it is able to identify patterns in the data that are not captured in standard probit analysis. We find that political factors matter, and do so in different ways for democratic and non-democratic regimes, and for domestic and external debt. In democracies, a parliamentary system or sufficient checks and balances almost guarantee the absence of default on external debt when economic fundamentals or liquidity are sufficiently strong. In dictatorships, high stability and tenure play a similar role for default on domestic debt.     

Entre cohérence et efficacité: la Suisse dans les négociations bilatérales avec l'Union Européenne

Comment conduire la politique extérieure suisse? Cet article s'intéresse aux négociations bilatérales entre la Suisse et l'Union européenne et cherche à évaluer la “cohérence” et “l'efficacité” des choix stratégiques du gouvernement suisse. A l'aide d'un cadre d'analyse incorporant des outils de la théorie des jeux, nous examinons les options et stratégies mises en oeuvre par le Conseil fédéral afin de concilier contraintes internes et contraintes internationales – ce que nous nommons la “cohérence” – ainsi que les liens entre cette recherche de cohérence et la capacité du Conseil fédéral à conclure un accord avec l'UE – ce que nous nommons “l'efficacité”. Nous nous concentrons sur les deux volets les plus sensibles des négociations bilatérales: les transports terrestres et la libre‐circulation des personnes. Dans le cadre des contraintes internes existantes, la difficulté première du Conseil fédéral a consisté à trouver une cohérence d'action basée sur des perceptions réalistes de la situation externe. Face à cette difficulté, le Conseil fédéral a globalement fait preuve d'habileté stratégique, en particulier dans le cas des transports terrestres. Dans ce cas, sa redéfinition de l'espace de négociation a permis de surmonter le dilemme existant entre cohérence et efficacité.     

Negativer Kompetenzkonflikt zwischen VwGH und Unabhängigem Umweltsenat; Aufhebung des Beschlusses des VwGH

Der Anwendung der in § 40 Abs 1 UVP-G 2000 und § 5 USG vorgesehenen Beschr?nkung der Zust?ndigkeit des Unabh?ngigen Umweltsenates auf Angelegenheiten des ersten und zweiten Abschnittes des UVP-G 2000 steht kein unmittelbar anwendbares Unionsrecht entgegen. Der als Gericht iSd Art 6 Abs 1 MRK sowie Art 47 Abs 2 GRC zu qualifizierende VwGH hat seine Zust?ndigkeit in der Sache daher zu Unrecht abgelehnt, sodass der die Beschwerde zurückweisende Beschluss des VwGH vom VfGH aufzuheben war.     

Intimate partner violence among pregnant and parenting Latina adolescents

The purpose of this study was to examine the nature and extent of mutual violence among a sample of pregnant and parenting Latina adolescent females and their partners. The sample consisted of 73 Latina adolescent females between the ages of 14 and 20 who were referred to a community-based organization for case management, education, and psychosocial support for pregnant and parenting adolescents. They completed the Conflict Tactics Scale (CTS-2) as part of a pretest to evaluate this intervention program. A small number (12 out of 73; 16%) reported no use of aggressive conflict tactics. Eighty-four percent (61 out of 73) of the study respondents reported using at least one form of minor psychological aggression and 62% (45 out of 73) reported using at least one form of minor physical assault over the past 6 months. Mutuality of conflict was high, especially in cases of minor assault by partner. There was no difference in severity or chronicity of conflict between those who were pregnant and those who were not. Female respondents reported that they and their partners engaged in comparable levels of sexual coercion. Discussion of the context of psychological, physical, and sexual aggression in adolescent relationships suggests alternative approaches to prevention of intimate partner violence among adolescents.     

Beyond Good and Evil: The Black–White Divide in Critical Race Theory

Derrick Bell’s work challenges the dichotomy that separates legitimate legal reasoning from “mere” fiction through hybrids that play across science fiction, Platonic dialogue, and autobiography. Despite its merits, I argue that Bell’s position reifies and strengthens, rather than deconstructs, structures of tyranny; it maintains the problematic rhetorical construction of United States race relations in terms of the black–white divide, either alienating, or leaving little or no room for other racial groups constructively to revise power and identity. In contrast, bell hooks’, Mari Matsuda’s and Robert Chang’s work, though tentatively sketched, construes current race and gender relations in terms of a chiaroscuro of power, rather than a simple dichotomy.
