Patenting of Research Results Related to Genetic Resources from Areas beyond National Jurisdiction: The Crossroads of the Law of the Sea and Intellectual Property Law

The conservation and sustainable use of marine biodiversity beyond national jurisdiction has attracted increasing attention from international fora over the last 15 years. A particular issue that is currently debated surrounds the regime for research activities related to biological resources from areas beyond national jurisdiction. This article considers the implications of patenting the research results of such activities in the context of the United Nations Convention on the Law of the Sea. It concludes that policy clarification is needed in order to ensure that any regime for bioprospecting in areas beyond national jurisdiction provides incentives for researchers and prospectors to continue uncovering the mysteries of the deep oceans, including through the issuance of patents, while at the same time ensuring a fair sharing of the benefits of research results with all States.

This article questions the assumption that globalisation has fostered cultural dialogue. In order to understand how globalisation has specifically impacted the sphere of the cultural, it starts by examining the way cultural practises are transformed in its wake. Does globalisation yield new, global forms of culture? To address this conundrum, this article takes the example of a cultural movement that has sought to project itself on a global scale, the anti-whaling culture, exploring both its origins and the distinctive cultural forms it has constituted. It then raises anew the question of dialogue: what of the dialogue between this global anti-whaling movement and local cultures where whaling still occurs? And how does such 'global culture' negotiate with demands for cultural diversity?     

Fiscal rules,fiscal outcomes and financial market behaviour

Since the outbreak of the eurozone's sovereign debt crisis, a range of fiscal policy measures have been adopted at the European Union (EU) and national levels that have given rise to claims of a significant reinforcement of fiscal policy constraint. Given the prominence and reinvigorated political appeal of fiscal rules in the EU and beyond, it is disconcerting how little we actually know about the link between fiscal rules, budgetary outcomes and market behaviour. In this research note, the aim is to take stock of the existing literature and challenge its contribution to the current policy debate on the merits of fiscal rules. Specifically it will focus on problems linked to endogeneity, measurements and contextuality.     

An analysis of the relationship between the additionality of CDM projects and their contribution to sustainable development

The Clean Development Mechanism (CDM) allows industrialised countries to use credits from greenhouse gas abatement projects in developing countries in order to fulfil their own emission reduction commitments. There has been mounting evidence that the CDM’s ability to fulfil its goals as stipulated by the Kyoto Protocol—contributing to the sustainable development of the host countries and delivering real, measurable and additional emission reductions—is less than satisfactory. In this article, an evaluation is made of CDM projects’ likelihood of being additional by assessing the impact Certified Emission Reductions have on the Internal Rate of Return of the individual projects. In addition, the projects’ sustainable development benefits are assessed by using a multi-criteria analysis. In a final step, the relationship between the projects’ additionality and sustainability contribution is assessed and a trade-off between these two CDM goals is established, revealing a potential inherent conflict in how the current mechanism works. The analysis is based on a systematic evaluation of 40 registered CDM projects in India.     

Enhancing Witness Memory with Focused Meditation and Eye-Closure: Assessing the Effects of Misinformation

Despite the decline in popularity of hypnosis as an investigative interviewing technique, this paper builds on previous research showing that some of the techniques employed in traditional hypnotic interviewing may still be useful in the development of simple, brief memory facilitation procedures for use by the police. Three experiments are described that investigate the effects of a short Focused Meditation with eye-closure technique in situations where participants are presented with misleading information. In the first study, which utilized a standard misinformation paradigm, a significant memory facilitation effect was shown with Focused Meditation, though the effect was not significant for eye-closure alone. There were no increases in errors when the Meditation and eye-closure procedures were used alone or in combination. The second experiment showed that a combined Focused Meditation with eye-closure technique reduced misinformation effects associated with fictitious events, and a third showed that the same technique reduced interrogative suggestibility effects as measured by the Gudjonsson Suggestibility Scale, whilst facilitating free recall memory. It is concluded that a Focused Meditation with eye-closure technique may potentially have applications in the field where brief alternatives to the Cognitive Interview are required.
