PARENTS BEYOND CONFLICT

This article describes a parent education program for high-conflict families in the Multnomah Country Circuit Court, Portland, Oregon. The method emphasized an educational approach teaching conflict resolution skills. This course was rooted in the tenets of cognitive restructuring: if parents think differently about the other parent and their shared task of raising their children, they will feel differently, and they will act differently. The authors beleived many of the difficulties between parents were caused by the negative perception of the other parent created during the spousal relationship. They also believed the key to successful co-parenting is to reframe these perceptions emphasizing cooperation and joint problem-solving. Furthermore, they believed as the cooperation and joint problem-solving improvement would have a positive, reinforcing effect. Finally, the authors believed parents must learn to separate conflict in the spousal role from conflict in the parenting role.     

Use of subpopulation data in Australian forensic DNA casework

DNA profiling evidence presented in court should be accompanied by a reliable estimate of its evidential weight. In calculating such statistics, allele frequencies from commonly employed autosomal microsatellite loci are required. These allele frequencies should be collected at a level that appropriately represents the genetic diversity that exists in the population. Typically this occurs at broadly defined bio-geographic categories, such as Caucasian or Asian. Datasets are commonly administered at the jurisdictional level. This paper focuses on Australian jurisdictions and assesses whether this current practice is appropriate for Aboriginal Australian and Caucasian populations alike. In keeping with other studies we observe negligible differences between Caucasian populations within Australia when segregated geographically. However segregation of Aboriginal Australian population data along contemporary State and Territory lines appears to mask the diversity that exists within this subpopulation. For this reason datasets collated along more traditional lines may be more appropriate, particularly to distinguish the most genetically differentiated populations residing in the north of the continent.

2007年职教攻坚以来,广西中等职业教育取得了很大成绩。然而从民族视角观察,广西中等职业教育仍存在一些现实困境,主要是各地享有的职业教育资源差距悬殊,少数民族地区的职业教育和民族中等职业学校经费投入偏低,农村尤其是民族地区农村的职业教育尚未真正走出低谷等。要解决这些问题,从民族视角进行思考,一要加大对民族贫困地区职业教育的扶持力度,推进中等职业教育区域间均衡发展;二要以转变观念为先导,以提高质量为保证,构建民族地区农村职业教育的复合型体系,切实推动农村职业教育发展。     

北约扩大及其前景分析

北约自1949年成立以来，历时60年，冷战时期的40多年里由成立之初的12国增加到16国，冷战后历经三轮扩大，由16国激增到28国，从而极大地改变了欧亚大陆的地缘政治格局，而这种扩大的趋势并未停止。北约扩大可确保北约盟主美国掌控欧亚大陆的主导权不受挑战，同时也将受到欧亚大陆诸大国的反对和制衡。未来北约扩大的方向和进程，将主要取决于美国与欧亚大陆各大国之间的战略博弈的结果。     

我国慈善事业发展中的政府作用分析——基于中美比较的借鉴与启示

经过多年的发展,我国慈善事业在取得了积极成绩的同时仍面临许多问题。本文从政府在慈善事业发展中的角色定位及作用入手,比较了中美两国慈善事业发展的现状与政府作用。我国慈善事业发展的历程集中体现了政府对慈善事业发展的主导作用,政府充当了慈善事业的组织者、运营者和资助者的角色;美国政府与慈善组织结为"事业伙伴"关系,发挥着倡导者、合作者、管理监督者、法律保障者的作用。由于历史、社会文化、宗教影响、法律环境等因素,中美政府在发展本国慈善事业中采取的措施与发挥的作用既有相似点又存有差异。借鉴美国的成功经验,中国慈善事业发展的核心问题就是要理顺政府与慈善的关系,政府在促进慈善事业发展中的作用应体现在引导、监督和保障方面。     

论冲突法上的适应问题

冲突法上的适应问题是一种法律关系的准据法同他种法律关系的准据法分别属于不同法律秩序时,应如何调整两者在适用上可能产生相互矛盾及不调和的问题。增强准据法的适应性或者说对准据法加以调整是当代冲突法的一个新动向。可以说,适应或调整程序浓缩了确定准据法的技术,冲突法上的某些制度本身就是适应观念的体现。在适应问题的解决方面,目前还难以制定统一的一般准则,总的来说,有冲突法的适应方法、实体法的适应方法和比较法的适应方法。适应问题不仅存在于法律适用阶段,而且也发生在管辖权协调和外国判决执行方面。
