论中共七大对中华民族伟大复兴的历史贡献

中华民族的复兴是一个伟大、长期、曲折的历史过程，这个过程需要数代人的艰辛奋斗方能完成。1945年4月召开的中共七大，是关系到全中国四亿五千万人民命运的一次大会。这次大会对中华民族的伟大复兴作出了重大的历史贡献，这次大会为中华民族的复兴提供了坚实的政治基础、科学的理论体系和指导思想、广泛的群众基础以及强有力的组织保证等四个方面。     

The European community software directive: The United Kingdom implementation

Conclusion The Regulations appear to have reinforced the protection available to software producers under United Kingdom law. The provisions of the Software Directive and the Regulations are complex and not without significant inconsistencies which are likely to prove to be a source of litigation. The drafters of the Regulations chose, unlike many of its European partners, not to adopt the wording of the Software Directive but to write their own interpretation, adding an element of uncertainty to the law in this area, which is perhaps inevitable bearing in mind the linguistic problems of translating and interpreting any directive coupled with the ambiguity and omission of definitions of several key terms. More important, however, than any academic argument will be the practical impact of the new law and its effectiveness in achieving its aim.     

An exploration of the “Spinback” phenomenon

This paper examines nine cases of “spinback,” the flow back to laboratories of technical advantage from technology transfer activities. The benefits revealed in the cases are discussed and assessed for their value to the participating laboratories and the scientists involved. The objective of this study was to explore and test the feasibility of undertaking a comprehensive study of the value of spinback in order to encourage support for technology transfer activities by middle management in a laboratory. Spinback is defined as the phenomenon by which scientists’ and engineers’ participation in technology utilization activities results in a technically valuable flow back to their laboratories or organizations, thereby increasing or improving techical capability. It was anticipated that this exploration would provide evidence that the phenomenon does occur, with important consequences for the organization.     

论我国刑事审判监督程序之改革

刑事诉讼法的修改是当前理论界和实务界关注的热点。作者选取其中的刑事审判监督程序(又称刑事再审程序)作为研究对象,从其存在和改革的必要性、重构的理念以及改革的具体设想三个方面进行了全面、系统的探讨。作者认为,刑事再审程序的存在是符合诉讼规律的,是实现司法公正所必需的;我国刑事再审程序对于实现司法公正和提高效率存在明显的缺陷,需要在更新观念的基础上进行改革。文章指出,现代化的刑事再审程序必须把追求公正、纠正错判和既判力理念、禁止双重危险规则结合起来。作者还就我国刑事再审程序的改革提出了若干建议。     

中俄两国商业银行不良资产处置之比较

中国与俄罗斯商业银行都面临着大量银行不良资产的问题，为提高银行资产质量。两国采取了一系列改革措施。两国在不良资产形成原因、处置措施方面存在相似之处和差异，将二者进行比较，可对我国的商业银行处置不良资产提出有益的启示和借鉴。     

Toxicologic findings in the USS Iowa disaster.

The toxicologic results from the 47 victims of the explosion on the USS Iowa are presented. Good correlation between carboxyhemoglobin saturations and cause of death was found. There were no correlations between blood cyanide concentrations and causes of death. Volatile analysis suggested postmortem ethanol production rather than antemortem ethanol ingestion. No drugs except nicotine were detected in any of the victims.

The use of the laser for determining the direction of the shots and the position of the victim's body in gunshot wounds

In this article a practical case is described when gunshot directions and position of a victim's body at the moment of each shot were determined by natural simulation using an LG-78 laser (made in the form of a gun).     

Dirty tricks of cross-examination

A mock jury study was conducted to test the hypothesis that perceptions of a witness can be biased by presumptuous cross-examination questions. A total of 105 subjects read a rape trial in which the cross-examiner asked a question that implied something negative about the reputation of either the victim or an expert. Within each condition, the question was met with either a denial, an admission, or an objection from the witness's attorney. Results indicated that although ratings of the victim's credibility were not affected by the presumptuous question, the expert's credibility was significantly diminished—even when the question had elicited a denial or a sustained objection. Conceptual and practical implications of these findings are discussed.This research was supported by funds provided to the first author by the Bronfman Science Center.
