犯罪存在的个体解释

<正> 犯罪不仅是一种社会存在,而且是一种个体存在。当然,这里的个体是作为社会成员存在的,离不开社会这个生态环境。但对犯罪的社会解释决不能代替个体解释。本文拟对犯罪存在进行个体解释,以期推进犯罪学的理论研究。 犯罪存在的个体解释的出发点是个体,这里的个体是社会关系的一定主体,因而只有在社会解释的总体框架下才能对犯罪存在作出科学的个体解释。在犯罪学中,犯罪存在的个体解释基本上有三种倾向:1.人类学解释,又称为生物学解释。德国犯罪学家施奈德指出:现代犯罪生物学理论与实证主义及其先驱者相衔接。这些理论不再断言犯罪仅仅是或主要是由遗传引起     

When ADR becomes the law: A review of federal practice

Conclusion With the passage of the Administrative Dispute Resolution Act, the stage was set for innovation and change in federal agencies. Now, part way into the five-year life of the Act, a new administration has the potential to encourage even wider use of ADR at the federal level, providing still more examples from which to develop a clearer sense of best practice. The onset of adult offending: A neglected dimension of the criminal career

The conventional wisdom in criminology is that adult onset of offending is a rare event. Closer examination of the extant literature that use official records, however, reveals that an average of 50 percent of adult offenders initiate offending at age eighteen or older. Although criminological research has investigated late onset offending in adolescence, there is little research on adult onset offending and the correlates of adult offending. Using police contact and interview data from the 1942 and 1949 birth cohort data from Racine, WI, this study investigated the correlates of crime for adult onset and persistent offenders. The results show that employment is the only correlate to affect the probability of adult offending differently for previously delinquent and nondelinquent offenders. This article concludes by highlighting the neglect of research on adult offenders, specifically the large percentage of adult onset offenders, and calling for more research on this topic.

Implementing Equal Justice for Parents in Washington: A Dual Approach

In many states, legal representation for parents of dependent children is inadequate and can be a source of delays in securing permanency for children and unnecessarily protracted court proceedings. Often, such parents also face barriers to accessing services and independent evaluators. These issues are being addressed in the state of Washington through two approaches. The first is a successful enhanced legal representation program that has substantially improved case outcomes. The second is a statewide committee using innovative means to examine systemic responses to the challenges of the Adoption and Safe Families Act.     

步巡盘查战术演练中常见问题及其对策

近年来我国各地暴力袭警案件时有发生,综合分析这些已发生的暴力袭警案件,多数因公安民警在执行清查、盘查、检查和缉捕等警务活动中防范、控制不当而造成的。因此,在平时对公安民警进行的盘查战术演练中,应进一步增强基层民警临战意识,提高民警安全防范能力,坚决贯彻依法、合理、有效使用武器的指导思想,尽快加强和提高基层民警警务战术的实战能力,避免不必要的伤亡事故。     

轻型颅脑损伤ABR的纵向研究

目的　探索轻型颅脑损伤的电生理学指标 ,为早期临床诊断和预后判断以及法医学活体伤害鉴定提供依据。　方法　对相关病例进行脑干诱发电位 (ABR)的动态观察 ,并对结果进行统计学分析。　结果　6 0例轻型颅脑损伤患者伤后 48小时ABR的检测 ,显示主要异常表现为I-III峰间潜伏期的延长 ,说明此类损伤可造成脑干的功能紊乱。同时通过对其中 40例进行ABR追踪检测 ,结果显示大部分患者受伤三个月后脑功能状态恢复正常。　结论　轻型颅脑损伤ABR变化具有一定的特征 ,提示可作为早期临床诊断和预后判断以及法医学活体伤害鉴定的客观依据 ,应引起关注并展开进一步研究。
