经济增长方式、人口增长与中国的资源环境问题

将中国的资源环境问题简单地归结为人口多和增长快,与事实不符。中国目前所遭遇的资源环境问题主要是粗放型经济增长方式及人们消费与生活方式变化的结果。工业化、城市化与现代化本身就是一个人均资源消耗不断增多的过程,国民贫富与人均自然资源之间并不存在必然的因果联系,资源与环境可持续利用对人口发展的要求和社会与经济协调发展对人口发展的要求不完全一致,在科学发展观指导下统筹解决中国人口问题具有重要意义。     

论枉法裁决罪的认定(下)

《刑法修正案(六)》第20条规定的罪名,是枉法裁决罪,而非枉法仲裁罪,称为枉法仲裁罪易致误解,并极易扩大修正案确定的适用范围。基于仲裁与诉讼的诸多不同,在枉法裁决罪的认定和适用上,不能简单地参照民事、行政枉法裁判罪的标准,而应在协调与仲裁立法(含《仲裁法》、《民事诉讼法》)及国际公约内容内在逻辑一致性的基础上,从严把握枉法裁决罪的犯罪构成及定案标准。     

The Taiwan Straits Situation since Ma came to Office and Conditions for Cross-Straits Political Negotiations: a view from Shanghai

The cross-Straits relationship has improved greatly since Ma Ying-jeo took over power in Taiwan in May 2008. However, people should not be over-optimistic, because all the positive changes enacted so far are not irreversible. It is important for both sides to seize this opportunity to advance the cross-Straits relationship step-by-step, and when conditions are right, to hold political negotiations and sign a peace agreement to end the status of hostility between them officially, so as to establish a framework for peace and development across the Straits, making the positive changes irreversible. The precondition for the signing of a peace agreement is a consensus on the one-China principle. Beijing has redefined the principle as ‘both the Mainland and Taiwan belong to China’. It is close to Taipei's original definition of one-China, which has been defined in the ROC's ‘constitution’ and other official documents. Both sides should make joint efforts to create conditions for political negotiations.     

The intellectual legacy of J.E. Hodgetts

Abstract: J.E. (Ted) Hodgetts was influenced by both the political economy approach that he learned at the University of Toronto and by the comprehensive historical method developed by Leonard White, under whom he studied at Chicago. His first great project, Pioneer Public Service, convinced him that responsible government was impossible without responsible public administration. The authors examine how his response to management theories and practices evolved following his participation in the Glassco, Lambert and Gomery commissions. Hodgetts consistently refused the complete separation of politics and administration, and he promoted the use of management techniques to strengthen parliamentary supervision of the public service. The two key components of his legacy are thus a commitment to the democratic values of representative government and the comprehensive study of the internal dynamics of public administration in interaction with the relevant environmental factors.     

The B.B.C. Arabic broadcasts

This is an account of the origins and history of the little-known British Advisory Mission in Vietnam (BRIAM), which sought to transfer to Vietnam the techniques used in the Malayan Emergency to isolate insurgents from the population at large, while at the same time winning the loyalty of that population. This article looks first at the situation in South Vietnam and second at how the US and the UK viewed that situation and what they were doing about it. The third section deals with what BRIAM itself tried to do in introducing the process labelled “strategic hamlets”. The final section seeks to explain why the process failed.
