法律制度出自人的手笔,所以与人的认知能力密不可分。例如,法典化以理性主义为哲学基础,法典崇拜折射出可知论的乐观;诉讼理论从追求“客观真实”转向“法律真实”,则表明人类开始承认自身认识能力的局限。波斯纳在《法律与文学》中认为:法律起源于复仇。在专门的司法机构产生之前,复仇是私人与家族的事务,由于私人复仇导致社会成本过大,逐渐出现了专业复仇机构——司法机关。这种观点给予了一种启示:法律的任务是了断。诸多法律制度验证了这一点:诉讼时效:两审终审;举证责任……这些制度设计都宛如歌曲《当爱已成往事》所唱,“真的该断了过去,让明天好好继续”。生活需要继续,冲突必须消解,所以陈年往事不再     

论思想政治工作理性教育与非理性教育的辩证统一

在当前思想政治工作中应正确地处理理性教育与非理性教育的关系。过去只重视理性教育的作用,忽视非理性教育的作用,是不正确的。同样,在新形势下一味强调非理性教育的作用,低估理性教育的作用,也是片面的。在思想政治工作创新中,应坚持理性教育与非理性教育的对立统一,辩证地认识与处理二者的相互关系。     

Nationalism,Internationalism and Chinese Foreign Policy

This article examines the role of nationalism in shaping Chinese foreign policy in the history of contemporary China over the last 100 years. Nationalism is used here as an analytical term, rather than in the usual popular pejorative sense. By tracing the various expressions of contemporary Chinese nationalism, this article argues that nationalism is one of the key enduring driving forces which have shaped Chinese foreign policy over the period; as China increasingly integrates herself into this globalized and interdependent world and Chinese confidence grows, the current expression of Chinese nationalism is taking a more positive form, which incorporates an expanding component of internationalism.     

几种主要流量检测方式的对比分析

The state action doctrine and the Local Government Antitrust Act: the restructured public hospital model

This Article analyzes the development and complexities of the antitrust state action doctrine and the Local Government Antitrust Act as these doctrines apply to both "municipalities" and private entities. The restructuring of a public hospital is used as a model to facilitate the antitrust analysis. The restructuring model, which typically involves the leasing of a hospital facility by a public entity to a private nonprofit corporation, offers the unique opportunity to compare the different standards employed under the state action doctrine and the Local Government Antitrust Act. As a practical matter, the Article provides a framework for a public hospital to evaluate the impact of corporate restructuring on its antitrust liability exposure and to develop strategies to minimize antitrust risks.
