试论晚清台湾词的文学意义及文化意义

清代是词学的全面复兴时期,然而海峡东岸的台湾在人清之后的前二百年里却没有产生一位真正意义上的词人.到了晚清,随着台湾社会文化的发展进步,这种局面发生了改变,同时出现了许南英、施士洁、洪弃生和林痴仙等本土词人.他们都亲身经历了晚清台湾的历史风云和沧桑剧变,特殊的历史环境和生平经历极大地影响了他们创作.晚清台湾词的文学史(词史)意义突出体现在“词史”与“词体革命”两个方面,而历史文化意义则主要体现在“台湾情结”和“爱国深情”两个方面.晚清台湾词作为宝贵的文学遗产,不应被词史研究忽视.     

徘徊于矫正正义与分配正义之间——刑事被告人补偿制度之提倡

刑事司法赔偿是为了填补基于国家违法行为而发生的损害,其最初是以私法领域中的侵权行为概念与理论为参照,并建立在矫正正义思想上的制度。刑事司法补偿则是为了填补因合法司法行为所造成的公民损失,其以宪法基本人权保障的观念为根本,并且以分配正义为基本原理。刑事赔偿责任与刑事补偿责任有着不同的正当性基础。我国《国家赔偿法》第十七条第(二)、(三)项属于刑事补偿责任性质,刑事补偿责任应以被告人没有刑事责任、权利侵害以及侵害程度达到特别牺牲的逻辑递进式三要件作为成立条件。

Research on the Affordable Housing Community: Review and Prospect

The construction of affordable housing is not only housing construction，but also community cultivation. The construction of affordable housing community is one of the key indicators to determine the effectiveness of the housing policy. Based on collecting related literature in CNKI, the researcher conducts a quantitative analysis of the research literature on affordable housing in China by using Bicomb2.0. The study has found that the quantity of research results is closely related to the development of the policy. The research focuses on the housing policy, financing and post management. Community research is marginalized in the research heat maps, and research disciplines are mostly human geography, management and so on. Then the researcher reviews the four core issues in the study of affordable housing community, such as the spatial location and community segregation of affordable housing, the satisfaction and influencing factors of housing community, the neighborhood interaction and social integration of affordable housing community and public service and community governance of security housing community. Finally, the paper provides proposals for future study.     

担保物权人物上代位权实现程序的建构

《物权法》第174条虽规定了担保物权的物上代位性,但现行法未建立一套合理可行的担保物权人据以实现物上代位权的程序。未来我国编纂民法典时应摒弃担保物权延续说,改采法定债权质权说,明确规定担保财产灭失、毁损或被征收而产生代位物请求权时,担保物权人依法享有针对这些请求权的法定债权质权;同时,应明确规定担保人的通知义务以及代位物给付义务人(即第三债务人)查询登记簿、在给付代位物前取得担保物权人同意的义务。代位物给付义务人违反义务,侵害物上代位权而给担保物权人造成损失的,应当承担侵权赔偿责任。     

正确理解群众路线与社会主义核心价值体系的关系

当前,在中国特色社会主义事业建设中,要提高我国的综合实力,就必须深入开展社会主义核心价值体系的学习和教育,并将群众路线贯彻其中。二者在本质上都是服务人民、联系群众,并且以实现社会主义价值理念为核心;群众路线在社会主义核心价值体系的学习教育和推广过程中得以丰富和发展;践行群众路线与社会主义核心价值体系的建设都是长期的过程,是曲折中前进的过程。     

Does Coproduction of Public Services Support Government's Social Equity Goals? The Case of U.S. State Parks

The growing phenomenon of government-supporting charities prompts the question of whether these institutions help or hinder public values of equity in service access. Logit and tobit regression analysis using multiple data sources from the California and Florida state parks systems compares public parks with and without supporting “friends” groups. The results suggest that while parks philanthropy has produced real benefits in rallying citizen support for improved public spaces, it also introduces some distributional consequences that policy makers should not ignore. Namely, a philanthropic failure hypothesis is supported whereby wealthier Florida counties with greater income inequality are more likely to benefit from a charity supporting a nearby state park. Finding no similar result in California, the authors conclude that the association between community wealth and park charity presence may also depend on state characteristics such as the funding structure of each state park system, not just community wealth differences.
