苦痛、困境与对策:我国农村“家暴”女性被害人权益救济研究——以坪石村、李岭村、王集村及榆中周边诸村为例

较之城镇地区的家庭暴力而言,农村地区针对女性的家庭暴力更为严重,受暴妇女更为无助。目前,对农村地区针对女性的家庭暴力的关注力度还不够,相关救济途径也缺乏实效。通过对坪石村、李岭村、王集村及榆中周边诸乡村的实证调查特别是对调研当地典型个案当事人的深度访谈发现,农村家庭暴力现状堪忧,应采取以建立针对‘家暴’施暴行为人的‘禁止令’制度为核心的若干因应性的应对方案。

东北亚区域即亚洲的东北部，区域面积为1750万平方公里，占亚洲陆地面积的40％，人口近6亿，占亚洲总人口的20％。按地理位置的分布来划分，包括俄罗斯的西伯利亚和远东两个经济区，中国的华北、东北和西北3个经济区，还有蒙古、朝鲜、韩国和日本。区域内中国是世界上最大的发展中国家；

Bringing the Spoken Words Back In: Conversationalizing (Postmodernizing) Police-citizen Encounter Research

In prior police-citizen encounter research, the words citizens and suspects articulate were used as the primary representation of their demeanor toward the police. Despite its central role in prior works, language has been presupposed into the analysis as a formalistic assumption, and unanalyzed in its own right. Realizing this deficiency, Mastrofski and Parks (1990) advocated changes in methods of observing police work. In this article, a discourse analytic method of capturing the neglected details of the encounter between police and citizens is proffered by using a reality based TV show about police work as data. The article provides the theoretical and methodological framework for overcoming deficiencies in existing police research. Seasonal Affective Disorder: Clerk Training and the Success of Supreme Court Certiorari Petitions

We investigate why the Supreme Court grants a smaller percentage of cases at the first conference of each term compared to other conferences. According to received wisdom, Supreme Court law clerks are overly cautious at the beginning of their tenure because they receive only a brief amount of training. Reputational concerns motivate clerks to provide fewer recommendations to grant review in cert. pool memos written over the summer months. Using a random sample of petitions from the Blackmun Archives, we code case characteristics, clerk recommendation, and the Court's decision on cert. Nearest neighbor matching suggests clerks are 36 percent less likely to recommend grants in their early cert. pool memos. Because of this temporal discrepancy, petitions arriving over the summer have a 16 percent worse chance of being granted by the Court. This seasonal variation in access to the Court's docket imposes a legally irrelevant burden on litigants who have little control over the timing of their appeal.     

论国际私法上的法律规避

国际私法中法律规避问题的实质涉及法哲学中一对基本价值———正义与安全———的二律背反。本文认为 ,在此问题上 ,法官透过当事人的表面行为探究其内心真意的做法是必要和合理的 ,即个别正义的价值在这个问题上具有优先性。在规避外国法行为效力的问题上 ,通过对法律规避行为的本质 ,其与公共秩序保留的关系及一些实际操作中具体问题的分析 ,得出结论 ,规避外国法和规避国内法的行为一样构成法律规避 ,应受法律规制。     

Rituals,Risks and Rivalries: China and ASEAN in the coming decades

This paper argues that Sino‐ASEAN relations, despite reassurances and determination by both sides to increase interactions and cooperation, have some remaining areas of contention and contestation. After its long isolation, self-imposed or otherwise, the PRC has been able to integrate itself successfully into the political life, economies, and security interests of the region. The PRC's market potentials, military capabilities and its enormous size have both excited and threatened the Southeast Asian states. While the Southeast Asian states have been willing to engage this emerging regional power, they are also wary of the potential risks when dealing with it. Increasing trade, investment, and cultural levels between the two regions have made both sides increasingly aware of the opportunities and challenges involved. The relationship is not without problems, although there is a general consensus that it is on a much better footing than in recent decades. The present developments of their relationships and in the next decade are analyzed under three categories: rituals, risks and rivalries.
