Since the creation of the Statute of Anne in 1710, the development of intellectual property (IP) norms has been primarily influenced by large actors in the private sector. This influence has expanded in the twentieth century to a global scale with the emergence of a number of international treaties aimed at harmonizing IP norms. This work argues that the 18 January protests of the Stop Online Piracy Act (SOPA) marks a shift in the norm‐creation process to smaller, more public‐minded influencers. This shift is happening for three primary reasons. While the introduction of empirical evaluation in the IP norm creation process and the apparent ideological inconsistencies of the previous paradigm have harmed the credibility of the present IP norm influencers, the internet has afforded novel participation in the norm‐creation process for a broad range of actors. 相似文献

Numerous studies have linked a range of economic, social, and institutional variables with corruption in government. Yet, most of this literature overlooks the management of public officials themselves. This is a relevant omission: almost all corrupt exchanges involve public officials. This article reviews studies—36 in total—that do address civil service management and anti‐corruption. It finds that prior works assess a narrow set of civil service management structures. Meritocratic recruitment and, less robustly, pay levels have been associated with lower corruption. By contrast, robust evidence on how corruption relates to other established public personnel management areas—such as distinct pay structures (rather than levels), promotion, transfer, and job stability practices—is largely unavailable. The article thus calls for research assessing the effects of a broader set of civil service management practices to gain a deeper understanding of corruption, and how to curb it. 相似文献

In the last decade, telepsychiatry – the use of telecommunications technologies to deliver psychiatric services from a distance – has been increasingly utilised in many areas of mental health care. Since the review by Khalifa and colleagues in 2007 the body of literature relevant to the forensic applications of telepsychiatry has grown substantially, albeit not by much in the United Kingdom. In the current review, we aim to provide an update summary of the literature published since 2007 to determine the effectiveness and feasibility of increasing telepsychiatry utilisation in forensic practice. The literature reviewed provides some encouraging evidence that telepsychiatry is a reliable, effective and highly acceptable method for delivering mental health care in forensic settings. There are also a number of papers that indicate the use of telepsychiatry may be cost effective for health providers in the longer term. Further research is required to consider the potential legal and ethical implications of using telepsychiatry in forensic settings. 相似文献

AbstractContemporary ‘realists’ attack the Kantian influence on political philosophy. A main charge is that Kantians fail to understand the specificity of politics and neglect to develop a ‘distinctively political thought’ that differs from moral philosophy. Instead, the critics say, Kantians are guilty of an ‘ethics-first approach to politics,’ in which political theory is a mere application of moral principles. But what does this ethics-first approach have to do with Kant himself? Very little. This article shows how Kant’s approach to political theory at a fundamental level includes political institutions, power, and coercion as well as disagreement, security, and coordination problems. In contrast to realists, Kant has a fundamental principle, which can explain why and guide how we ought to approach the political question, namely the norm of equal freedom. Yet, Kant’s theory does not take the form of a moralistic ought addressed to the isolated individual, but concerns a problem that we share as interdependent beings and that requires common institutions. The fruitfulness of the Kantian approach, then, is that it can take the political question seriously without being uncritical of actual politics and power, and that it can be normative without being moralistic. 相似文献

This article reflects on the merits and shortfalls of bilateral research programmes aimed at strengthening climate change research capabilities, using the experience from two programmes, the PACC and IHCAP in Peru and India, respectively. The study highlights key aspects of these types of bilateral programmes, namely: capacity; performance, salary and appreciation; funding; bureaucracy and hierarchy; publishing; and data sharing. Furthermore, it emerged that these programmes would benefit from a more extensive consolidation phase of the research activities and partnership rather than rapidly transferring into out- and up-scaling phases. 相似文献

Development plans with insufficient knowledge about local realities, and that do not share technical or planning details with the target communities, bedevil development practice. This study used a form of participatory modelling in three fishing communities in Nicaragua to enable fishers to explore their economy and the potential impacts of fishery-based development projects. Co-designing a model of the fishing economy in the form of a board game created a forum in which facilitators and participants could arrive at a shared understanding of local fishing practices and the costs and benefits of strategies for addressing the fishers’ priorities. 相似文献

The Internet is receiving increasing attention as a medium for technology transfer between public research and the business sector. Technology policy hopes that Internet presentations of research activities at public institutions will facilitate the exploitation of research results, particularly from those institutions not engaged in technology transfer so far. Based on a survey of public research units in natural sciences and engineering in Germany, we analyze the determinants of firm contacts established via the Internet. Special attention is paid to the effect of experiences in firm interaction in the past. Estimation results suggest that Internet contact to firms is more likely to be established by public research units that are already well situated in the transfer market. Research units that orient their homepage design towards the business sector are more likely to build Internet-based contact with firms. However, there is no evidence that public research units that have not been engaged with firms so far, use the Internet more intensively to get into the transfer business. Our results show that the Internet has a certain potential for advancing technology transfer at public research, although this potential is not fully utilized yet, at least in the case of Germany. 相似文献
