Resisting the advance of the security state: The impact of frameworks of resistance on the UK'S securitisation agenda

From the turn of the new century, the UK witnessed an unprecedented advancement in the state's security apparatus. These developments and their human rights implications have been extensively documented by the socio-legal and wider academic community. However, less well-understood has been the forms of resistance which have placed fetters on the operation of state powers. This article identifies three dominant frameworks through which resistance to the ‘securitisation agenda’ has materialised. In doing so, we assess the relative ‘successes’ and ‘limitations’ of each framework. Ultimately, we seek to identify the frameworks that offer the greater transformative potential in promoting alternative forms of security to those promulgated by the ‘new terrorism’ discourse.     

Myths,Measures and Modernisation: A Comparison of Local Authority Performance in England and Wales

Local Authority performance in Wales is widely perceived as inferior to that in England. We analyse statistical evidence on current levels of performance and rates of improvement in the two local government systems, and find few significant differences between English and Welsh councils. Adverse judgements on Welsh local government seem to reflect perceptions of their management processes and methods of service provision rather than their substantive achievements. This may in turn be symptomatic of UK central government's assumption that public service improvement cannot be achieved unless organisations follow the specific model of ‘managerial modernisation it is currently promoting.     

The building of the democratic tradition in South Africa's trade unions after 1973

This article traces the emergence of the democratic union tradition in the trade union movement that emerged in the wake of the 1973 strikes in South Africa. Contrary to the conventional wisdom that attributes the emergence of this tradition solely to a generation of young white union activists and labour-supporting intellectuals, the article argues that this tradition owes its origins to a multiplicity of sources. The article emphasises the social character of trade unions and how they bear the imprint of the historical and cultural heritage and social experiences of their members and leading activists. Thus the article challenges the notion that a social group enters into new associational forms as a tabula rasa. Instead, it claims that the building of the democratic union tradition in South Africa is not just an outcome of intellectual influences but significantly was shaped by the workers' ‘lived experiences’.

因我国刑事公诉审查程序流于形式带来诸多弊端,对其改革已经成为必要。但如何改革仍未形成定论。要不要及如何设立公诉审查程序,成为我国公诉审查程序改革的两大焦点问题。公诉审查程序对于制约滥行公诉、保障被告人人权、促进审判公正具有不可或缺的价值。应当反思我国公诉审查程序的理论与实践,借鉴法治国家的经验,科学合理地构建我国的刑事公诉审查程序,为我国刑事诉讼法的再修改提供参考。

建立中印自由贸易区的难点问题与对策研究

近年来,中印两国关于建立中印自由贸易区（RTA）的研究取得了明显的进展,但尚未进入政府间的谈判,要建立RTA还有不少难点与挑战。主要是历史及边界遗留问题、现实产品市场竞争及能源竞争问题、预期利益分享的计算问题等一时难以逾越的障碍和挑战。在现阶段仍可从以下方面多做些工作：完善两国政治及军事交流与合作机制,理性疏导两国国内的民族主义情绪,在涉及各国国内敏感问题时应给予相互尊重,加强双方在关税和非关税领域合作力度,完善双方已有的区域合作机制,加强专业人才交流与培训,等等。
