受审能力探析

受审能力是被告人接受法庭审判的能力。我国对受审能力的研究还处于起步阶段,立法上还有许多空白之处。本文从评定标准、提起、确认与法律后果等方面对受审能力进行了探讨。

医疗保障制度的改革和建设,直接涉及千家万户的切身利益,为积极稳妥推进重庆市医疗保险制度改革,我们应针对现行医疗保险制度中存在的一些亟需解决的问题,积极采取措施,在加大医保投入的同时,合理控制医疗支出,规范医院的诊疗行为,提高对参保人员的保障程度。     

Inter-/Intra-observer Reliability of Hand Assessment Using Skin Detail: A Count-based Method

Skin detail of the hand is used in photographic comparisons, yet its reliability has not been evaluated. This study examines a count-based method for documenting skin features. In Part I, 14 individuals counted skin features on 40 color images of the hand, three of which were repeated. An average correlation value of 0.557 was obtained for interobserver assessment; values ranged from 0.545 to 0.832 for intra-observer assessment. The variation in correlation values for hands suggests that there are certain distinguishing characteristics that increase reliability. In Part II, 17 examiners assessed 20 nonrepeated grayscale images of hands by circling skin features. An average correlation value of 0.674 was obtained, but visual assessment of examiner markings suggested some examiners grouped features whereas others viewed them individually. The results suggest further research is warranted, some hands may be more suitable for comparisons, and a standardized method for examining skin features is needed.     

异体评估:我国政府绩效评估的路径选择及理论建构

我国政府绩效评估工作在经历了十年的快速发展以后,最近有陷入评估困境的趋势。同体评估是困局之源,其解决需要在理论层面有所突破。从评估对象界定切入,对政府绩效评估的性质进行分析,提出及解释了"管理评估"和"治理评估"两个范式,并尝试提出了"异体评估"概念,在此基础上提出构建以人大为主导的政府绩效评估主体结构的理论框架。基于人大的异体评估路径切合我国政府绩效评估的内涵及其肇兴的体制改革诉求,有望建立起适合中国实际的政府绩效评估动力机制,进一步释放评估活力。     

行政执法中法律与情理的冲突及其处理

情理是人的通常心理和事情的一般道理,是人们日常生活中的经验法则。法律来源于社会,又服务于社会,法律应该以社会普通民众的情理为基础,情理往往代表着法的价值取向。但情理不是具体的法律规范本身,行政执法者在处理具体案件时,只能以相关法律的具体规定为依据,不能以情理作为判案的直接依据。但法官也不能机械地适用法律,要注意法律与情理的协调。合理的裁决或判决结果较容易为当事人和社会公众所接受以及信服,这样才能真正树立起法律的权威。     

The effect of dynamic legal tradition on financial development: panel data evidence

This study examines the effect of dynamic legal tradition on financial development. In line with the theory of “dynamic legal tradition” proposed by Beck et al. (Law, politics, and finance. World Bank, Washington, DC, 2001), political variables are employed in the analysis to assess whether these variables could affect the legal environment and hence financial development in countries with different adaptability. The empirical results from the panel data of 60 counties for the period 1980–2006, show that political power could change the legal environment, especially in common law countries, which in turn could affect the development of financial systems. The result demonstrates that political factors that promote shareholder rights greatly influence the development of financial system followed by political factors that promote investor protection.
