The literature on cosmopolitan justice has yet to address what principles to adopt when duties of global justice and duties of social justice are in conflict. In this paper, I address David Miller’s contention that some may fall into the justice gap since we need to prioritize duties of social justice in cases of conflict. I argue that Miller’s analysis depends on three stipulations: the incommensurability of the values underlying duties of social justice and those of global justice; the need to justify duties of justice to their holders; and the need to consider the necessary institutions to realize and implement justice obligations. I argue against the incommensurability clause by showing that both conceptions of justice pursue moral equality as the underlying and commensurate value. Instead, I propose that the currencies of justice we employ in the two contexts of justice are different. Discussing the justifiability clause I agree with the stipulation that we have to justify decisions that affect the realization of justice to those who have to carry the burden of realizing them. This implies, however, that we may have to accept that some prioritize duties of global justice over duties of social justice. If this is the case, it seems as though the state has little recourse to prioritize duties of social justice. Finally, discussing Miller’s institutional clause I ask why the justice relevant institutions can only be those of the state. It is plausible to say that in our current world, institutions of humanitarian aid are effective means to satisfy duties of global justice.  相似文献

This paper investigates the development and adoption of governance modes in the field of human biotechnology. As the field of human biotechnology is relatively new, voluntary professional self‐regulation constituted the initial governing mode. In the meantime, with the exception of Ireland, all Western European countries have moved toward greater state intervention. Nevertheless, they have done so in contrasting ways and the resulting governance modes for assisted reproductive technology and embryonic stem‐cell research vary greatly. Instead of imposing their steering capacity in a “top‐down” fashion, governments have taken pre‐existing self‐regulatory arrangements in the field into account and built up governance mechanisms in conjunction with private actors and pre‐existing modes of private governance. Our analysis demonstrates that the form and content of the initial self‐regulation explain why the self‐steering capacity of the medical profession was largely or at least partially preserved through hybrid governance systems in Britain and Germany, while in France the self‐regulation was entirely replaced by governmental intervention.  相似文献

This article introduces two new concepts—dispersed submission (DS) and sexation—in an interrogation of the general structures and nuanced practices of the global sex industry. There is considerable stress on the ways in which practices of domination during colonialism set up a form of racio-gendered ‘path dependence’ now imbricated in the current neoliberal global political economy. The arguments emerge from both material practices and careful consideration of the extant literature on the subject. One of the most significant aspects of the article is the effort to go beyond the already rich literature on the trafficking–sex-worker binary debate. Methodologically, the article employs a spacio-temporal model much informed by the work of Frantz Fanon and Fernand Braudel of the French Annales.  相似文献

Studies on news values have provided many insights into what gets reported in the media. In this study we use the concept of news values to examine how journalists perceive the newsworthiness of party messages. Taking an innovative approach, fictional party press releases are used to test for the influence of five important news values in the context of political news in a factorial survey experiment. This allows us to study those news values in relation to one another in a controlled experimental setting, an advantage over traditional gatekeeping studies. Political journalists in Switzerland and the Netherlands were asked to indicate whether they would consider these press releases for reporting or not. Findings show that the power status of the party, unexpectedness, and the magnitude of the political action announced influence journalists’ perception of newsworthiness. Messages from parties that were part of government were more likely to be selected for coverage in the Netherlands, whereas the party did not matter in Switzerland, where power is distributed more evenly. This shows that political system characteristics influence the work of journalists. Opposed to results from content analyses of news output, some news values (personal status, conflict) did not prove to be relevant. The extent to which sexual offenders are a group separate from other types of offenders has been debated for many years and investigated from different perspectives. The present study investigated similarities and differences regarding socio-economic background, criminal history and recidivism involving new crimes between rape offenders and three other groups: other sexual offenders, non-sexual violent offenders and other offenders. Data came from Norwegian population registers containing information on all crimes investigated from 1992 to 2012. The sample consisted of all persons convicted in 2002 and 2003 (N = 36,951). Background characteristics and estimated recidivism risk was described using hazard models. Results indicated that men convicted of rape (n = 142) had lower levels of education and that a higher percentage of them were on social benefits compared to the other crime groups. A large majority (79%) of rape-convicted men had previous convictions. Rape offenders were considerably more criminally active and diverse than the other crime groups. Prior criminal record, irrespective of type, increased the risk of recidivism in general. Controlling for other background characteristics did not alter this outcome. Treatment of convicted rapists needs to take into consideration that this offender group has much in common with violent offenders in general.  相似文献

We assess the fairness and ambition level of the EU’s Intended Nationally Determined Contribution (INDC) of reducing domestic greenhouse gas emissions by at least 40 % relative to 1990. For this, we calculate which reduction targets for other major emitting economies are comparable to the EU target, given widely diverging effort-sharing approaches. We introduce a novel approach in which the EU target is taken as starting point for allocating emission reductions to other regions. Under this approach, the global emission level is an outcome of the analysis, contrary to standard effort-sharing approaches in which the global climate goal is specified. We find that the INDC of the EU, if other regions take on comparable targets based on a differentiated convergence per-capita approach, could be sufficient for a global 2 °C pathway. However, if emissions are allocated according to a historical responsibility approach, the global emission level in 2030 is much higher than the level of 2 °C pathways. Furthermore, we conclude that India, Mexico, and Brazil have more ambitious INDCs than the EU according to both a differentiated convergence per-capita approach and a historical responsibility approach.  相似文献

Through a comparison of typical and deviant cases, this study probes and refines the augmented power model which argues that the structural power of the financial industry fosters its instrumental power in influencing regulatory reforms under certain scope conditions. It shows the industry's success in influencing policymakers to authorize municipalities to use derivatives and thereby to financialize their debt management in the US (typical case). The failure of banks to acquire such a law in the UK (deviant case) reveals a hitherto little-noticed condition under which this power explanation collapses: states' fiscal and monetary constitution. We demonstrate that analyzing the operation of finance power requires a precise consideration of how states' fiscal and monetary constitution structures governments' responses to financial industry's regulatory preferences. Moreover, we conclude that synthesizing business power research with literature on the mutual dependence between states and finance helps to explain patterns of state financialization.  相似文献

Changes in family formations in western industrialized countriessince the 1960s have not been reflected in cross-national researchin the area of child maintenance. This article outlines childsupport regimes in 14 countries, considering the locus of formaldecision making, the determination of child maintenance obligations– highlighted by way of national informant responses totwo fictitious vignette scenarios – and the enforcementand penalty provisions used in the event of non-compliance.The article concludes that while some broad trends can be identifiedacross countries, there is diversity in how countries respondto family change.  相似文献
