公民有序参与的影响因素分析

公民有序参与受各种因素的影响,其中,政治制度化、公民权利意识、社会自组织、政府作用是最为重要的四个因素。高程度的制度化意味着公民参与渠道的完善和成熟,是公民有序参与进行的规则基础。较强的权利意识是公民有序参与的心理基础。发达的社会自组织网络是公民有序参与的组织基础。公正灵活的政府主导是公民有序参与的能促性基础。     

两岸权利质权之比较

随着物品证券化的兴盛 ,尤其是知识产权的出现 ,质权的适用范围进一步扩大 ,权利质权应运而生。由于我国担保法和其他相关法律关于权利质权的规定存在不完善之处 ,因而通过与我国台湾民法典在权利质权的概念、权利质权的标的、权利质权的设定等方面的比较 ,以便对完善立法有借鉴作用。     

Can Social–Emotional Learning Reduce School Dropout in Developing Countries?

An alarming number of students drop out of junior high school in developing countries. In this study, we examine the impacts of providing a social–emotional learning (SEL) program on the dropout behavior and learning anxiety of students in the first two years of junior high. We do so by analyzing data from a randomized controlled trial involving 70 junior high schools and 7,495 students in rural China. After eight months, the SEL program reduces dropout by 1.6 percentage points and decreases learning anxiety by 2.3 percentage points. Effects are no longer statistically different from zero after 15 months, perhaps due to decreasing student interest in the program. However, we do find that the program reduces dropout among students at high risk of dropping out (older students and students with friends who have already dropped out), both after eight and 15 months of exposure to the SEL program.     

中印缅孟经济走廊建设的重点、难点及对策

2013年5月,中国国务院总理李克强访问印度期间倡议建设的中印缅孟经济走廊,已经成为我国面向西南开放的重要战略支点,对四国而言都具有重要的战略意义。从当前贸易、投资、旅游往来和通道建设情况看,中印缅孟经济走廊建设初具雏形,但仍然受到一些硬性制约。深入推进经济走廊建设,应着重基础设施、产业园区、旅游、能源、农产品、金融等方面的合作,本文也提出了对策建议。     

Coping with the Global Financial Crises: institutional and ideational sources of Taiwan's economic resiliency

Over the last two decades, Taiwan has weathered two global financial crises: the Asian financial crisis of 1997–1998 and the sub-prime loan crisis of 2008–2009. Each time the island's economy emerged from the crisis relatively unscathed. Many of the elements that constitute Taiwan's economic resilience have been fostered through entrenched institutional arrangements and established policy orientations over a long period. Taiwan managed to retain the bulk of these long-running sources of economic resilience despite the tremendous external pressures exerted by neo-liberal policy advocates to dismantle these ‘out-dated’ policy thinking and practices in the name of reform during the decade-long interval between the two crises. Taiwan was able to cope with the 2008–2009 global financial crisis thanks also to a more enabling regional environment created through stronger cooperation among Asian economies and under a new awakening among the East Asian policy makers.     

高职民事诉讼法课程教学改革与研究

通过对我院民事诉讼法教学现状与存在问题的调研,揭示并分析教学实践中存在的教学方法陈旧、教学效果不理想等问题的原因.以高职教育的教学理念为指导,提出对该学科教学进行改革的思路,探索课堂教学目标与方法,就实践教学模式的建立和完善提出建议,以实现教学内容、方法、手段的规范化.     

从《反垄断法》的颁布看市场竞争机制的法律构建

在市场经济条件下,企业要真正地开展市场竞争,必须创造一个良好的市场竞争环境。《反垄断法》的颁布实施可以说为建设一个公平竞争的市场环境,在立法上已迈出了最重要一步。但从实际的情况来看,要真正构建一个公平竞争的市场环境,仍然任重而道远。     

船舶碰撞责任条款下保险人责任之确定

许多国家的船舶保险条款中碰撞责任条款规定:当碰撞两船没有船舶援引责任限制时,保险人与被保险人之间碰撞责任的确定适用交叉责任原则.但海上保险理论界和实务界对于援引责任限制的情形下是否适用单一责任制却存在误解.本文通过具体案例中保险人责任的演算,论证了单一责任制适用的不合理性,并提出了"不完全交叉责任制"的理论.
