This article considers the problem of extraterritorial human rights violations committed by transnational corporations (TNCs), and draws on Crouch's framework in Post‐democracy to illustrate why the issue has proved so difficult for states to regulate. I begin by examining the problem of corporate regulation more generally, and set out Crouch's analysis to show why and how corporations have become so influential. The second section considers the area of business and human rights, and explains why there is ‘a governance gap’ in relation to extraterritorial human rights violations committed by corporations. The third section describes efforts at the international and domestic levels to regulate corporations in relation to this issue. It concludes that while new international principles and innovative hybrid schemes are playing a valuable role in norm creation and standard‐setting, the enforcement of these principles remains limited. Corporations have largely succeeded to date in their lobbying efforts to remain free of any direct obligations under international law. 相似文献

Received wisdom holds that the provision of vital public services necessarily improves the legitimacy of a fragile or conflict‐affected state. In practice, however, the relationship between a state's performance in delivering services and its degree of legitimacy is nonlinear. Specifically, this relationship is conditioned by expectations of what the state should provide, subjective assessments of impartiality and distributive justice, the relational aspects of provision, how easy it is to attribute (credit or blame) performance to the state, and the characteristics of the service. This questions the dominant institutional model, which reduces the role of services in (re)building state legitimacy to an instrumental one. A more rounded account of the significance of service delivery for state legitimacy would look beyond the material to the ideational and relational significance of services, and engage with the normative criteria by which citizens judge them. 相似文献

The following symposium tackles an important debate in the field of international studies research and in social science research more broadly. Originating as presentations at the 2002 International Studies Association meetings in New Orleans, the following set of papers examines issues concerning the potential replication of research results from a number of different conceptual and technical perspectives. It also spans an array of journals and journal editors in our field that confront issues of replication on a regular basis. The interactions generated by this symposium have already led to the agreement, detailed at the end of the symposium among the four leading internations relations journals to adopt a single common replication policy. The editors of these journals challenge others to follow their lead. The Editors of ISP hope that this symposium begins a larger discussion on these issues and invites commentary from interested scholars. The purpose of this study was to evaluate the efficiency of the Cozart® RapiScan (CRS) drug test system for detecting opiates and cocaine in oral fluid. Oral fluid samples were collected using the Cozart® RapiScan collection system from 358 donors who were receiving treatment for their addiction and were monitored for drug misuse. A further 103 oral fluid samples were collected from volunteer donors who were not drug users. The samples were analyzed in the laboratory using the two-panel Cozart® RapiScan cartridge for opiates and cocaine and confirmed using gas chromatography–mass spectrometry (GC–MS). The samples were stored frozen at −20 °C until analysis by GC–MS. The overall accuracy of the CRS for both opiates and cocaine was 100%. Samples spiked at 50% above and below the cut-off consistently gave negative and positive results respectively. A total of 88 samples were positive for various opiates and 111 samples were positive for cocaine and/or its metabolites. The CRS for opiates and cocaine in oral fluid, using a cut-off of 30 ng/mL morphine or benzoylecgonine equivalents in neat oral fluid, had overall efficiencies of 98% and 99%, respectively, versus GC–MS. A series of potential adulterants of oral fluid were evaluated and shown not to alter the outcome of the test result. 相似文献
