Following Amartya Sen, this paper contends that the capability approach provides a better framework for thinking about human well-being and development than more traditional approaches which typically focus on utility or resources. This is illustrated by drawing on the results of a survey which investigated how ordinary people in South Africa view human well-being (a ‘good’ form of life). However, the results of this exercise indicate that the capability approach overlaps with both utility (happiness, pleasure, etc) and resource-based concepts of well-being. The distinctions between commodities (and their characteristics), human functioning and utility is less robust than Sen implies. In particular, the capability approach needs to make more space for the role of utility (defined broadly to include all valuable mental states) and say more about the material basis of well-being. 相似文献

This paper presents results from a nationally representative cross-sectional survey of married women (N?=?3,500) in the West Bank and Gaza Strip. Interviews assessed the 12-month prevalence of participants’ exposure to psychological, physical, and sexual intimate partner violence (IPV) and risk factors including: demographic characteristics, several factors of marital relations, stressful life events, political violence, status inconsistency, family size, locality, region, help resources in the community, and locality-level acceptance of wife abuse. The prevalence estimates of IPV were: psychological aggression, 50 % minor and 12 % severe; physical assault, 17 % minor and 6 % severe; and sexual coercion, 4 % minor and 6 % severe. Results revealed that stressful life events, husbands’ controlling behavior, and marital conflicts were related to all forms of IPV (all p-values?<?0.05). Greater locality-level acceptance of wife abuse was statistically associated with greater odds of each type of violence except sexual violence. If the relationship between international tribunals and reconciliation remains empirically under‐researched within the transitional justice literature, this is even truer in respect of hybrid and local courts. Seeking to address this gap, the purpose of this article is to explore whether the State Court of Bosnia and Hercegovina (BiH) – and more particularly its War Crimes Chamber (WCC) – can contribute to reconciliation in BiH. Unlike the International Criminal Tribunal for the Former Yugoslavia (ICTY), the State Court is located in the country itself. Hence, in theory at least, it has greater potential to involve local people and thus to facilitate the reconciliation process. In practice, however, the Court faces many of the same problems as the ICTY, including perceptions of bias and the difficulty of satisfying victims. What this ultimately demonstrates is that criminal trials are not a panacea or “magic bullet” and that reconciliation – both in BiH and in post‐conflict societies more generally – requires a comprehensive and holistic approach to transitional justice that does not over‐rely upon the administration of retributive justice. Abstract Two experiments examined the efficacy of an optional deadline lineup procedure for distinguishing correct from incorrect eyewitness identification decisions. The procedure involved briefly presenting the lineup, removing the lineup from view, then giving participants the option of either making an identification decision or viewing the lineup again. When compared with participants operating under a forced deadline (i.e. forced to respond after the brief presentation) or standard lineup instructions, the optional deadline procedure identified participants with an impressive probability of having made a correct identification when used with target-present lineups and biased instructions. With unbiased instructions, the optional deadline produced clear discrimination between correct and incorrect identification decisions for choosers and, importantly, also for non-choosers. This article examines the workings of the Ombudsman scheme in Britain and France, concentrating, as regards the former, on the work of the Parliamentary Commissioner for Administration. Major criticisms made by Chressanthis and Shaffer (C-S) are addressed: the authors' failure to include noneconomic variables in the regression model, the inclusion of open elections in the sample, and the use of variables other than the state unemployment rate as economic performance measures. Errors in C-S's interpretations are noted. Additional regression results are reported using modifications of the authors' original model.
