Sovereignty in the Balance: Claims and Bargains at the UN Conferences on the Environment, Human Rights, and Women

States vary the content and subject matter of their claims to sovereignty. In an analysis of when states invoked sovereignty at recent UN World Conferences on the environment (1992), human rights (1993), and women (1995), the authors revise and extend Litfin's (1997) notion of bargains among components of sovereignty. At the conferences, states invoked sovereignty in debates over cultural and religious values, economics, and increased international accountability. The authors interpret the debates based on how four elements of sovereignty—autonomy, control, and legitimacy in the eyes of other states and nonstate actors—are traded by states through implicit or explicit bargaining. They identify patterns that vary by issue area. The authors argue that nongovernmental organizations as well as other states may legitimate or delegitimate states' sovereign claims. They find that countries of the global South made more sovereignty claims of all kinds than Northern states. And, sovereignty bargains may be struck more easily over power and economics than social values.

Substitution Is in the Variance: Resources and Foreign Policy Choice

This article argues that foreign policy substitution arises as a result of the costs of foreign policies relative to state resources. States with few resources are constrained in foreign policy choice compared to states with an abundance of resources. As a result, states with few resources will, on average, select, lower‐cost policies than will resource‐rich states. Resource‐rich states, by virtue of their abundant resources, have greater discretion over policy choice and thus behave less uniformly than do resource‐poor states. Our empirical results provide evidence of this and support the argument that substitution is in the variance.

More Than IndyRef2? The Referendums (Scotland) Act 2020

Demands for a second Scottish independence referendum have persisted since 2014. The Scottish government introduced the Referendums (Scotland) Bill at Holyrood in May 2019 to enable referendums within the competence of the Scottish parliament. The Scottish National Party (SNP) government presented this as a framework enabling a range of referendums. Opponents saw this as legislating for a second independence referendum. The act will form a large part of the legal framework and rules for any second independence referendum. Importantly, the legislation provides innovation in electoral law more generally. This article discusses the background to the bill, its initial contents, and debates around and amendments to the bill. It discusses its electoral law innovations, before considering its limitations and place as constitutional debates play out over a second independence referendum.
