Fraudulent arson in Britain does not show a pattern of significant involvement by organised crime. This gives it a lower profile and, apart from a minority of cases prosecuted as crime, leaves most to be negotiated between insurers and insureds. Interviews with loss adjusters led to 71 cases being identified covering 1990–1995. The resources of the two sides in attempting to achieve and to resist payment of the claims and their success are evaluated. Because of the circumstantial nature of the evidence, lengthy negotiations are usual, along with an element of bluff, in what can be characterised as a process of private justice.The author gratefully acknowledges the support of the University of Liverpool Research Development Fund in connection with the field work on which this article is based.  相似文献

The attacks of 11 September 2001 created a new paradigm for domestic security in the United States. The struggle against terrorism, particularly catastrophic terrorism, became the government’s most important priority. In the wake of these attacks, the Department of Homeland Security was established, with broader powers of enforcement, set forth in new legislation such as the Patriot Act. This new focus on homeland security will have a secondary effect on the efforts of the US to deal effectively with a range of soft security threats in that it will increase attention to those concerns, particularly as they are seen as enablers of terrorism. The establishment of the Department of Homeland Security is the largest reorganization of the US government in over 50 years, and will necessitate a reordering of the inter-departmental relationships on security matters as well as those critical to soft security cooperation with friends and allies abroad. Although the new department has absorbed many aspects of enforcing the nation’s laws, other functions key to soft security remain spread throughout other US government agencies. A comprehensive understanding of this new order will be key to enhancing the international struggle against soft security threats.  相似文献

The Scottish National Party (SNP) was elected into government in 2007, and in January 2012 announced plans for an independence referendum. In the same period, the SNP government implemented substantial cultural and heritage projects — some of which showcased the long history of Scottish-English animosity. In the accompanying political rhetoric, it was clear that the SNP was utilising history for the 2014 independence campaign. This referendum ultimately resulted in Scotland's retention of the Union, though the SNP remained in power. The Scottish-British relationship was further tested in 2016, however, with the UK referendum on leaving the EU. All Scottish electorates voted in favour of remaining, and the chasm between Scottish and British identities and future trajectories has since widened further. This article compares the SNP's promotion of nationalist historical narratives prior to the 2014 referendum, particularly those seen in government-supported heritage initiatives, with subsequent historical narratives expressed especially through diplomatic engagements in light of Brexit. In doing so, the infusion of nationalist histories in contemporary Scottish politics — and the potential complications of this approach for the SNP in the post-Brexit political landscape — will be highlighted.  相似文献

In the study of Buddhism it is commonly accepted that a monk or nun who commits a pārājika offence is permanently and irrevocably expelled from the Buddhist monastic order. This view is based primarily on readings of the Pāli Vinaya. With the exception of the Pāli Vinaya, however, all other extant Buddhist monastic law codes (Dharmaguptaka, Mahāsāṅghika, Mahīśāsaka, Sarvāstivāda and Mūlasarvāstivāda) contain detailed provisions for monks and nuns who commit pārājikas but nevertheless wish to remain within the saṅgha. These monastics are not expelled. Rather, they are granted a special status known as the śikṣādattaka. In this paper I explore the rules. concerning pārājika penance and the śikṣādattaka with specific regard to monastic celibacy. Given that five out of six extant law codes recognise this remarkable accommodation to the rule of celibacy, I argue that we must look to Vinayas other than the Pāli Vinaya if we are to arrive at a nuanced and representative view of Indian Buddhist monasticism.
