The Joint Custody Symposium Project examined almost 600 court files in five judicial districts to investigate the common perception that joint custody contributes significantly to relitigation rates. Data indicated that joint custody as a factor accounted for only 10.8% of court returns. Financial concerns accounted for the majority of actions. Disputes over child custody appeared to be related to finances as well. Unfortunately, returns to court do not necessarily resolve the financial needs of divorced parents. The findings suggest that children may be used as pawns in court battles over money that are disguised as parenting concerns, as evidenced by the close relationship found between visitation or custody disputes and child support modification filings. 相似文献

For over the past twenty years, the United States has witnessed a pro-patent movement. In response, numerous concerns have been raised, including possible impediments to innovation in cumulative technologies, emergence of anti-commons, barriers to entry and an elevation of costs of innovation associated with defensive patenting, growth in patent litigation and poor quality patents. Efforts to integrate complementary and alternative medical (CAM) therapies into conventional medical settings are creating a variety of negotiation challenges between various stakeholders. Focusing on the two-party encounter between physician and patient offers a way to understand the application of principled negotiation to perhaps the most fundamental and emotionally charged place within the health care system in which the introduction of CAM therapies is likely to disrupt relationships and produce conflict. This article suggest ways in which the theory and analysis of principled negotiation can add to current liability and ethical frameworks, and might thereby contribute to optimal future health care by helping to wisely integrate CAM therapies into conventional medical care. 相似文献

Approximately 100,000 foreign advisors work in the public sectors of Sub-Saharan African countries at an annual cost of more than $4 billion. The numbers, range of services, and costs of such advisors increased during the 1980s while at the same time donors launched new efforts to build professional capacity in the African civil service. The study illustrates the potential of the 'doing gender' perspective to explain why employment does not always improve women's household–power. Eighteen in–depth interviews with women maquiladora workers in Mexico suggest that, depending on the gendered meanings of household negotiations, employment may help women gain new rights and extend the limits of respect accorded them by male companions and parents. Nevertheless, women were more successful when they used negotiating strategies that conformed to their gender identity, such as making offers , than when they used negotiating strategies that challenged traditional gender norms, such as withdrawing services or making threats . 相似文献

The aim of this study was to clarify whether positive results for prostate‐specific antigen (PSA) and acid phosphatase (AP) occur in postmortem swabs from the genito‐anal region in males (n = 80; 4 regions) and females (n = 20; 3 regions) and to calculate the positive predictive value (PPV) concerning the presence of spermatozoa. In male subjects, the highest incidence of positive test results was found in urethral swabs (PSA 76%, AP 71%) and the lowest frequencies appeared in perianal and rectal swabs (15–20%). Microscopic evaluation for spermatozoa was positive between 39% in urethral swabs and 1% in rectal swabs. PPV regarding positive identification of spermatozoa was 33.3% for PSA and 31.5% for AP. The combination of both tests yielded a PPV of 38.2%. In female cases, no spermatozoa were identified, and one case was PSA‐ and AP‐positive in perianal swabs. Our findings indicate that PSA and AP tests are of limited value for the postmortem detection of spermatozoa in male subjects. 相似文献

This study concerns how intraorganizational networks affect the implementation of policies and practices in organizations. In particular, we attend to the role of the informal subgroup or clique in cultivating and distributing locally adapted and integrated knowledge, or know‐how. We develop two hypotheses based on the importance of intraorganizational coordination for an organization's capacity for change. The first emphasizes the importance of distributing know‐how evenly to potential recipient subgroups. The second emphasizes the importance of restricting know‐how to flow from high know‐how subgroups. We test our hypotheses with longitudinal network data in 21 schools, finding stronger support for the second hypothesis than the first. Our findings can help managers cultivate know‐how flows to contribute to organizational change. 相似文献
