Cold Case Homicides: DNA Testing of Retained Autopsy Sexual Assault Smears

Archival medical examiner specimens may contain perpetrator DNA evidence useful in unsolved (“cold case”) homicides. The Office of the Chief Medical Examiner (OCME) histology slide archives were searched for sexual assault smears for all 376 female homicides from 1990 to 1999. Of these, the OCME had sexual assault smears on 84 of which 13 slides had sperm. Of these 13, six were still unsolved. DNA profiles were obtained on all six (5 from smears and one from swabs). Combined DNA Index System ( submission resulted in two matches (“hits”) for new suspects. In addition, three suspects were eliminated in two cases. Our review of archival sexual assault smears resulted in DNA profiles that were able to assist in the investigation of four cold case homicide investigations. It may be worthwhile for medical examiner offices to search their archival histology slides for sexual assault smears on previously unsolved cases particularly those prior to the mid‐1990s when DNA testing was less widely available.     

Firing Back at the Backfire Effect: The Influence of Mortality Salience and Nullification Beliefs on Reactions to Inadmissible Evidence

Two studies were conducted to explore psychological factors that contribute to the influence of inadmissible evidence (i.e., the backfire effect) on jurors' verdicts. On the basis of hypotheses derived from terror management theory, we predicted that reminders of mortality, in contrast to an aversive control topic, should lead participants to be less punitive when confronted with inadmissible (as opposed to admissible) evidence, when participants were either situationally induced or dispositionally prone to follow their personal sense of justice. In Study 1, control participants who scored high on a measure of nullification beliefs, and thus were prone to relying on their own sense of justice rather than the law, exhibited the backfire effect. However, reminding participants of their mortality reduced the damaging influence of inadmissible evidence. Study 2 extended these findings by showing parallel effects with a manipulation of nullification proneness via judicial instructions. The implications of these factors on the judicial process are discussed.     

Hyperextension and rotation of head causing internal carotid artery laceration with basilar subarachnoid hematoma

Hyperextension of the head can cause injury to the vessels at the base of the brain. These lacerations are believed to be caused by stretching of the vessels due to the abrupt movement of the head and rotational acceleration of the brain within the cranium, and they usually occur in the intracranial portions of the vessels, producing a subarachnoid hemorrhage. This is the case of a 35-year-old man who received a blow to the face that forcefully hyperextended and rotated his head to the left. Autopsy revealed an intracranial right internal carotid laceration extending from a calcified atherosclerotic plaque. This unusual injury may be due to a combination of blunt force applied to the head and the alteration of the vessel's structural and functional capacities secondary to atherosclerosis.     

Understanding the Costs of Litigation: The Case of the Hourly-Fee Lawyer

What does it mean to talk about the “cost of civil justice”? What can be done to bring down that cost? This article addresses these two important questions. Drawing on data collected by the Civil Litigation Research Project, the authors first examine the components of cost and then present an extensive analysis of what is by far the dominant element of the cost equation-legal services. The analysis of the cost of legal services examines the amount of time lawyers devote to cases and the rates they charge for their time. The major factors influencing time include adversariness, stakes, litigant goals, and court (federal versus state); hourly rates appear to be determined primarily by the legal services market. The article closes with a discussion of the implications of the results of the analysis for reforms of the civil justice system that might seek to lower the cost of justice.     

Multilateral resource cooperation among Northeast Asian countries: Energy and mineral joint venture prospects

Northeast Asia is one of the world’s richest regions in energy and mineral resources. The tremendous reserve base is enhancing prospects for multilateral economic cooperation in the region, including the exploration, development, trade, and utilization of hydrocarbons and precious metals. This article examines the emerging opportunities for regional cooperation in resources within Northeast Asia, while also reviewing historical cooperation in the energy and minerals industry. Potential obstacles to multilateral resource cooperation are also identified. The authors conclude that small- to medium-scale joint venture projects involving energy and minerals have a more reasonable chance of being established in Northeast Asia than do mega-projects.     

Feminist consciousness and candidate preference among American women, 1972–1988

Recent research has suggested that women with a feminist consciousness differ from nonfeminists in their attitudes and values. This paper investigates the impact of feminist consciousness on candidate preference and vote choice in presidential elections from 1972 to 1988. In those elections in which candidates took divergent positions on feminist issues, feminism was a significant predictor of candidate preference after controls for demographic variables, political attitudes, and partisanship. In elections in which the candidates took similar positions, however, feminism did not affect candidate preference. The 1980 election was the exception: in that election, feminists cast relucantant ballots for Carter, while rating John Anderson higher.
