The authors trace and compare the developments in recorded juvenile delinquency in Hamburg, Prague, Cracow and Budapest from 1991-1997 and then analyse the processing and selection procedures of the various justice systems. They devote special attention to ethnic minorities within this filtering process. The most salient feature is that the crime rates and processing structures in the former socialist countries display considerable similarities. It would almost be possible to speak of a specific type of criminal justice system with a typical form of reaction. While in the West, the large number of suspects is considerably reduced during later stages of selection to a much smaller number (those actually sentenced and/or imprisoned), what the authors call a funnel model, in the East a smaller number of suspected offenders enters this selection process, but tends to remain within it and be sentenced - the cylinder model. These procedural structures have changed little in the 1990s, and there has certainly not been any increasing alignment of the Eastern systems with the Western one. Indeed, the difference has, if anything, become greater. These lower crime statistics as compared with the West - represented here by Hamburg - are, however, not only the result of equally large discrepancies between the real crime rates, but in this regard the pro-active crime prevention measures of the police, which in Hamburg have caused the inclusion of an increased number of juveniles and foreigners in the crime statistics since 1995, have also had a great effect. The research project thus clearly demonstrates the importance of interpreting crime statistics neither as a true representation nor as a distorted reflection of the activities of a criminal justice system. Instead, these statistics should be seen as reflecting specific processing procedures and methods of crime control.  相似文献

The article presents an analysis of the expected impact of EU accession on the Hungarian education, training and academic research system with a number of recommendations for an integration policy in these sectors. The first part of the article develops four themes: (1) the current level of preparation of the country for accession in the education sector, (2) the possible longer term benefits of accession, (3) the shorter term costs and (4) the most important elements of a policy of integration. A distinction is made between material and cultural, and that of political cost and benefits, the stress being laid on the second. One of the conclusions of the author is that accession may open up a number of new opportunities for the development and modernisation of the country but that these can be exploited only if the country has a coherent sectorial strategy. Specific preparation actions are proposed in the areas of school education, higher education, vocational training and research policy. The article presents a list of the most important short term government measures and the needs for institutional development. It also makes a proposal for possible further themes of investigation and research. This revised version was published online in July 2006 with corrections to the Cover Date.  相似文献

No reliable data are available on cases of lethal child abuse (by active force) in the area of Federal Republic of Germany prior to reunification (the former West Germany). In a multicenter study we therefore examined the police and court records for such cases occurring in the period 1 January 1985 to 2 October 1990 in nearly the entire area of Federal Republic of Germany. RESULTS: The study center received information on 58 cases of lethal child abuse. Extrapolated to all institutes of legal medicine, this corresponds to 62 cases in all of West Germany in the period studied. An approximately equal number of unreported cases should be added to this figure. Including unreported cases, at least 20 cases of lethal child abuse occurred per year; thus only one in every two cases ever came to light. Almost two thirds of the victims were younger than one year old. At autopsy 59% exhibited signs of repeated abuse at autopsy. By far the most common cause of death was direct impact from a blunt object, usually to the head. Mostly, the male person to whom the victim relates most closely (father, stepfather, partner of the mother) has killed the child. Twenty-one of the 74 persons charged saw the charges against them dropped or were acquitted due to lack of evidence; 51 received sentences ranging from one year probation to life. In the remaining two cases the outcome of the trial was unknown. Signs of abuse were readily apparent at autopsy in almost all cases. The high number of unreported cases underscores the need to educate medical students and practicing physicians to be on the look-out for signs of abuse and argues for an increase in the rate of autopsy.  相似文献

Forensic investigations often demand a clear definition of secretor status. Lewis-typing of secretion stains may help to verify non-secretor results and to identify mixtures of secretions from Le (a-b-) persons and secretors (or non-secretors). Furthermore it gives an additional check on secretor status, determined by ABO-grouping. Few problems may arise, when testing prepared saliva or semen stains. Therefore our interest was focussed on the possibility of Lewis-typing in stains appearing in forensic case work such as cigarette tips, stamps and envelope flaps, semen stains and vaginal swabs, nasal secretion, sweat and urine stains. All stains with the exception of sweat and urine were successfully Lewis-typed. In saliva stains Lewis substances could be determined even after 5 years and in semen stains for at least up to 40 days.  相似文献

Abstract. Canada's plurality vote system has been criticized recently for contributing to the regional and linguistic imbalance of the parties in Parliament. While many of the criticisms are undoubtedly correct, some of the promises held out on behalf of a reformed electoral system are open to question. Before Canada seriously considers abandoning its present electoral system, the assumptions made about alternative systems and the arguments presented on their behalf deserve closer scrutiny than they have so far received. By reflecting on the nature of political change and the representative process in Canada this paper comments critically on the adequacy of some of the claims put forward by the reformers. These claims relate specifically to increased party ‘credibility’ and ‘sensitivity’ under a different electoral system. The paper suggests that some of the claims made on behalf of a reformed system are doubtful, that representation in the sense of acting for others could be more a feature of the current system than of any reformed one, and that further research is needed before any final decision is made to alter the present electoral system. Avant que le Canada n'envisage 1'abandon de son systeme electoral actuel, il faut regarder de plus près qu'on ne l'a fait jusqu'ici les suppositions concernant des systemes de rechange et les arguments presented en leur faveur. En reiléchissant sur la nature du changement politique et sur le processus de la representation en cause, l'auteur fait une critique du bien-fonde de certaines des pretentions avancées par certains reformateurs. Ces critiques portent, plus précisément, sur la ← credibility → et la ← sensibility → d'un systeme electoral different. The case for an altered Canadian electoral system must be examined a good deal more critically than it has been to date. This essay attempts to contribute to that process by examining a few of the claims made recently on behalf of a reformed electoral system and by commenting on those claims in the light of Canadian political experience. The paper is not intended to make a virtue of the present system but it does raise questions about the liklihood of a reformed system living up to its advance bil-ling. How is the problem defined? What are some of the benefits claimed on behalf of a reformed system? What are the notions of representation underlying the arguments? If answers could be suggested to such questions as these, they may give cause to reflect on the general case being made in support of an altered system and on the appropriateness of abandoning or altering the present system without further study. Although the recent literature on electoral reform in Canada has been sizable, its quality has been uneven. Between the two notable contributions of the last decade (the Cairns-Lovink debate of 1968-70 and the Irvine monograph of 1979) a number of government reports, chapters in books, and newspaper articles were published. If some of the arguments and assertions of this admittedly mixed group remain unchallenged they may in the long run prove seductive to an unsuspecting public, academic as well as general, looking for much more to come from a reformed system than it can possibly deliver. Certainly it has not yet been established in the literature that the electoral system warrants such critical analysis in isolation from or, indeed, at the expense of other representational concerns which in themselves may be more crucial to the healthy operation of the Canadian polity than a reformed electoral system.  相似文献

A synoptic study of six cases of self-inflicted sharp force injuries is presented, where young, mostly female people had simulated assaults to gain sympathy or other personal advantage. The morphological distinctives of simulated assault wounds from such of real assault are worked out and the common situative and motivative background is cleared up.  相似文献
