American Skin: The Duke Lacrosse Rape Scandal and the Intersection of Race,Class, Gender,and Injustice

The Duke lacrosse team rape case showcased how race and the criminal justice system can intersect in troubling ways. This is not news to students of the history of race in America. What makes this case unusual is white men were the ones who were mistreated by the police, prosecutor, media, and others, all of who used the rape allegations to further their cause rather than to seek justice. This book review essay examines three recent books that describe and analyze the Duke scandal.     

Tort Reform and Physician Sanctioning

This article examines the relationship between changes in tort rules and the sanctioning of physicians by state medical boards. It compares the sanctioning rates for doctors in states that have passed tort reforms with the rates in states that have not made legislative changes. It concludes that alterations to the joint liability rule may have increased sanctioning, while the addition of pre–trial screening panels and regulation of attorney fees may have limited the number of physicians who receive punishment.     

The Minefield of Australian Military History

Between 2014 and 2018 Australia, like many other nations, is commemorating the centenary of the First World War. This article explores the difficulties that many academics have in traversing the divide between academic and popular history, and suggests why the public reaction to academic military history is often so hostile. It points to the role of national ideals that are underpinned by the Anzac mythology surrounding egalitarianism, mateship and martial courage, and to the role performed by conservative commentators. However, the article also argues that the popularity of military history in Australia, and growing signs of openness to challenging interpretations from some organisations, present opportunities for academic and professional historians, who in turn must rise to the challenge as part of their responsibilities as public intellectuals.
