破产撤销权的制度设计

破产撤销权作为一种保护破产宣告之前债权人利益的制度,设定的目的在于保护全体债权人的整体利益,对于任何损害债权人整体利益的个别清偿行为或减少破产财产的行为予以撤销,以期实现破产法许可债权人公平合理的分配债务人破产财产的基本宗旨。破产撤销权制度设立的理论基础为具体制度的构建提供了合理性标准,为具体制度的实施提供了有力保障。     

后金融危机阶段美国对华关系新定位与亚太地区安全战略调整

随着中国国际作用影响的迅速上升,适应中国和平崛起的态势,成为奥巴马政府对华关系新定位与调整亚太地区安全战略的重要背景条件。奥巴马上台后,中美关系大起大落,表明金融危机阶段的中关关系正在发生深刻变化,奥巴马政府第二个《中美联合声明》提升两国关系定位,对华政策呈现出从“接触加遏制”政策向“尊重加牵滞”政策调整的取向,美国亚太地区安全战略也进一步调整。这一战略调整,不能简单解读为以中国为主要战略目标。发展“相互尊重、互利共赢的合作伙伴关系”,是中美两国共同努力的目标,但是实现这一目标依然存在战略互信基础脆弱的局限。     

Why can't development be managed more like a funeral? Challenging participatory practices

The adoption of techniques to elicit community participation in development practice is an important step forward. The question remains whether this is sufficient for development outcomes that accord with the aspirations of ‘participants’. Community perceptions are somewhat different, as our own conclusions demonstrate. We have developed a ‘methodology of inclusiveness’, based on community institutions which embed collective social action in everyday life. We use the analogy of funerals as collective action in which activities are planned, roles are demarcated, responsibilities are assigned, and desired outcomes are realised. We ask the question: why can't development be managed more like a funeral?

东亚现代化的“特殊”与“一般”

作为"后发外生型"现代化的典型代表,东亚社会现代化存在着复杂的宏观互动结构。如果我们将东亚现代化研究史上的"日本特殊论"和"亚洲停滞论"置于"传统—现代"的背景之下展开分析,就会发现,无论是"亚洲停滞论",还是所谓日本"特殊论",实际上是以欧美现代社会为基准加以展开的,其理论系谱从属于西方,难以洞悉东亚现代化的深层逻辑。鉴此,我们应注意揭示东亚现代化进程中由激进的"压缩式发展"向"内发式发展"转变的共同历程,超越"西方中心论"和"发展主义"的制约,将东亚的社会发展理论植根于本土,揭示东亚现代化进程中"特殊"与"一般"的复杂互动关系。     

Detection of ethyl glucuronide in blood spotted on different surfaces

This study aims to show that sensitive detection of ethyl glucuronide in dried blood spotted onto various surfaces after a period of 24h is feasible. At present, there is insufficient information how tightly ethyl glucuronide (EtG) binds to various materials and how easily it can be eluted. 4ml aliquots of blood samples obtained from seven volunteers after consumption of alcoholic beverages were applied to six different surfaces. After drying and a 24h-storage at 20±2°C the samples were re-dissolved in water, and EtG was subsequently analyzed by a LC-MS Paul-type ion trap. A comparison was made between dried and corresponding fluid samples. EtG was detectable in all subjects' samples following consumption of alcohol. EtG was also detectable after a storage time of four weeks at 4°C in whole blood that had been preserved with EDTA. EtG was detectable in all samples dried on different surfaces and its concentration remained relatively constant irrespective of the particular condition of the material. Detection of EtG in blood spots from the scene may indicate recent alcohol consumption in cases where collection of blood remained undone or could not be performed.
