The main issue in the Masiya judgment was whether the current South African definition of rape—namely non-consensual penetration of a vagina by a penis—should
be extended to include anal penetration of both female and male victims. The majority of the Constitutional Court held that
anal penetration of female victims should constitute rape, but declined to offer similar protection to male victims. This
note argues that this judgment reverts to and reinforces patriarchal stereotypes and dichotomies and that it misunderstands,
in a profound way, central concepts such as sex and gender and the gendered nature of rape. It further suggests that, instead
of being an aberration, the judgment actually fits into a pattern of conservative judgments about gender and sexuality by

Established in 1950, the Colombo Plan was a comprehensive program of foreign aid provided to South East Asian nations. In this article I argue that the Colombo Plan had a much broader political and cultural agenda, and cannot be understood from a humanitarian perspective alone. By exploring some of the cultural, ideological and political underpinnings of the scheme I illustrate that, as part of a comprehensive foreign policy, it is best understood as being motivated by international security priorities and the need to ally domestic cultural concerns. Although the Colombo Plan was inherently defensive, it also proved to be something of a progressive force which prepared the ground for a much closer relationship with (and within) the Southeast Asian region. 相似文献

In 2002 Germany adopted an ambitious national sustainability strategy, covering all three sustainability spheres and circling around 21 key indicators. The strategy stands out because of its relative stability over five consecutive government constellations, its high status and increasingly coercive nature. This article analyses the strategy's role in the policy process, focusing on the use and influence of indicators as a central steering tool. Contrasting rationalist and constructivist perspectives on the role of knowledge in policy, two factors, namely the level of consensus about policy goals and the institutional setting of the indicators, are found to explain differences in use and influence both across indicators and over time. Moreover, the study argues that the indicators have been part of a continuous process of ‘structuring’ in which conceptual and instrumental use together help structure the sustainability challenge in such a way that it becomes more manageable for government policy. 相似文献

This article analyzes governmental responses for the climate change challenge in China and Brazil. Both countries have a central role in the climate change debate since they are major greenhouse gases emitters, thus contributing to the aggravation of the problem, each with differentiated participation. At the same time, policy measures aimed at climate issues in these countries may lead to the reconfiguration of international negotiations on the topic. Stakeholders are demanding nonprofit organizations (NPOs) continually improve and work effectively in an ever-changing environment. While there are many ways to approach this operational challenge, this paper examines the impact of acquiring an accountability certification, specifically the Standards for Excellence® Certification. Using a sample of 102 NPOs that have received the Standards for Excellence certification, we find that the certification is associated with increases in public support relative to a control group that did not receive the certification. These results suggest that some stakeholders favorably respond to the certification process, and NPOs can realize tangible benefits from becoming certified. 相似文献
