Arresting Statistics: The Drift to Informal Justice in England and Wales

This paper re-examines some of the current theoretical models and paradigms of criminal justice in England and Wales based on an analysis of national arrest statistics between 1981 and 1997. The data show that there has been a large increase in the number of arrests in the period but the number of people prosecuted has declined. An increasing number of people are being arrested and released without any further action. The principal argument is that there has been a radical shift in power away from the formal open and public system of justice towards a more informal closed system. The paper concludes that while these trends lend support to a number of theoretical perspectives on the criminal justice process, particularly Choongh's social disciplinary model, the radical transformation which has taken place in the form of criminal justice can only be understood within the broader politics and economic structures of modern Britain.     

The Extension of the Criminal Law to Protecting Confidential Commercial Information: Comments on the Issues and the Cyber-Context

Confidential commercial information is an increasingly valuable commodity and commercial resource which may be inadequately protected by the traditional approach of English criminal law against misappropriation. This paper reviews the nature of the problem and some of the relevant legal issues. Notwithstanding that a global reform of the law in this area is probably not on the cards, the position advocated here is that the direct application of the criminal law is indeed an appropriate vehicle through which to deter the misappropriation of confidential commercial information. However, the scope of any new law must be carefully circumscribed - if it is drawn too wide, the law runs the danger of acting outside of the articulated rationale for criminal liability and endangering other legitimate interests (particularly in the cyberspace context). If it is drawn too narrow, any new law may very well prove ineffective. It is suggested that there are a number of difficulties, both doctrinal and practical, that must be resolved prior to enacting new legislation in this area. Some observations are presented upon the more critical issues for those interested in the implications of law reform in this area for cyberspace.

Adolescent women's developing identity: A study of self-definition in the context of family relationships

This study generated adolescent women's perception of their identity in relation to family members spanning three generations and related these perceived relationships to their sex-role orientation. Subjects were 20 firstborn university women from intact families. The methodology used multiple sources of information, including open-ended interviewing procedures, rating scales, and standard research measures of sex-role identity. Significantly more constructs empirically differentiated family by generation than by sex. Congruence of young women with both the parent and grandparent generation, relative number of masculine stereotypes produced, and personality traits of males and females were significantly influenced by the presence of a brother in the sibling generation. There was no relationship between family constellation and sex-role orientation. Feminine women were significantly more congruent with other females in their family than androgynous women. There was a linear trend for androgynous women to be increasingly individuated across the generations.Received her Ph.D. from Yale University. Ideology and personality: Aspects of identity formation in adolescents with strong attitudes toward sex-role equalitarianism

Middle-class adolescent boys and girls with strong attitudes for and against the sex-role ideology of the Women's Movement were administered a Q-sort to study two aspects believed to be related to identity formation: flexibility-rigidity and independence-dependence. A significant positive relationship was found, more strongly for independence than for flexibility and more strongly for girls than for boys. More favorable attitudes toward sex-role equalitarianism were associated with flexibility and independence. The strength of the associations varied with the nature of the Q-sort: ideal self, self as ideal member of opposite sex, and self as ideal to each parent.This article is based on the dissertation by Dr. Kirsch in partial fulfillment of the Doctor of Philosophy Degree at the Graduate School of Education, University of Marylandm, College Park, MarylandPsychotherapist in private practice in Potomac, Maryland, with special interest in psychology of women. Comparison of adolescents' perceptions and behaviors in single- and two-parent families

This study investigated the self-concepts, school achievement, occupational aspirations, vocational maturity, and perceptions of parents of children from two-parent and single-parent homes. The sample contained 559 children, 19% from single-parent homes. A multivariateF indicated children from two-parent homes had significantly higher school grades and occupational aspirations. There were also significant differences in children's perceptions of relationships with fathers, but not with mothers. It was argued that family structure has an impact on adolescents' perceptions and behaviors.Received his Ph.D. from the State University of New York at Buffalo.
