Haftung bei Vereitelung der “ohne Gentechnik”-Kennzeichnung: ein legislatorischer Unfall

Zusammenfassung  Die Novellierung des Gentechnikrechts von April/Mai 2008 l?sst die zivilrechtliche Haftungsnorm des § 36a GenTG unberührt. Mittelbar wird die Haftungslage durch eine Modifizierung der ?ffentlichrechtlichen Vorschriften zur “ohne Gentechnik”-Kennzeichnung jedoch drastisch versch?rft. Dies weckt europa- und verfassungsrechtliche Bedenken und wirft die Frage auf, ob diese Konsequenz vom Gesetzgeber wirklich beabsichtigt war. Der Beitrag untersucht die neue “ohne Gentechnik”-Kennzeichnung, arbeitet ihre haftungsrechtlichen Folgen heraus und zeigt die europa- und verfassungsrechtlichen Bedenken des eklatant versch?rften Haftungsumfangs auf.     

Das informell-kooperative Verwaltungshandeln im Umweltrecht

Zusammenfassung  Informelles Verwaltungshandeln geh?rt zum umweltrechtlichen Alltag. Die technische Entwicklung und die zunehmende Komplexit?t umweltrelevanter Sachverhalte veranlassen den Staat dazu, jenseits der hergebrachten Handlungsformen des ?ffentlichen Rechts in den wirtschaftlichen Bereich einzuwirken und das ursprünglich subordinative Staat-Bürger-Verh?ltnis in eine auf Konsens zielende Kooperation umzustrukturieren. Der vorliegende Beitrag befasst sich mit der noch nicht abschlie?end gekl?rten rechtlichen Bew?ltigung informeller staatlicher T?tigkeit. Der Schwerpunkt liegt dabei auf dem sog. normvollziehenden Verwaltungshandeln. Besondere Berücksichtigung findet die Teilformalisierung informeller Verhaltensweisen de lege lata und im Referentenentwurf zum UGB.     

Paradigmenwechsel in der europäischen Umweltrechtsetzung?

Zusammenfassung  Der europ?ische Umweltrechtsgesetzgeber verwirklicht seine umweltpolitischen Ziele in zunehmendem Ma?e durch planerische Instrumente, insbesondere durch die Pflicht der Mitgliedstaaten zur Aufstellung sog. Ma?nahmen- oder Aktionspl?ne. Dabei sollen durch die entsprechenden Planerstellungspflichten vor allem die europarechtlich vorgegebenen Umweltstandards oder -ziele erreicht werden. Eine erste Bestandsaufnahme und Typisierung des Instrumentes der Ma?nahmenplanung legt nahe, dass es sich um eine übergreifende Form der Regelungstechnik handelt. In der Folge werden daher übersektorale Problemkomplexe und m?gliche gemeinsame Umsetzungsfragen erkennbar, die sich auf konzeptionelle Spannungen zum deutschen Umweltrecht, Anforderungen des deutschen Verfassungsrechts und Rechtsschutzfragen beziehen.

A comparison of methods used in the UK and Ireland for the extraction and detection of semen on swabs and cloth samples

The recent formation of a United Kingdom and Irish working group, the Body Fluids Forum (BFF), highlighted the need to investigate different working practices prior to any inter-laboratory comparison work and identification of best practice. Various dilutions of semen were seeded onto swabs and cloth samples for each BFF member laboratory to test using their standard techniques. The results showed that the detection of acid phosphatase on swabs is best achieved using direct testing rather than on an extract from the swab. Extraction methods for spermatozoa require a balance to be achieved between using a sufficient volume of water to ensure optimal release and minimal volume to ensure a concentrated extract. PSA tests were investigated and found to be more sensitive than Choline. DNA profiles were obtained from samples in which no spermatozoa had been detected during microscopic examination.     

Gramsci,the peasantry and popular culture

Antonio Gramsci adopted a developmentalist position after becoming a marxist. He thus departed from earlier Italian positions in foreseeing a society in which peasants — understood as a structure of petty property and its dependants ‐ would eventually though not immediately be peasants no more after the introduction of modern methods of cultivation. After the success of fascism in 1922 he began to reconsider his assumption that the peasantry were destined to disappear in a new mode of production, which would replace the backward dual economy of Italy. If the peasantry were not always in secular decline before the onward march of capitalism, but could, as in Italy, increase in numbers and political strength even under capitalism, then this called for a reassessment of their social and political role in a marxism which was not simply developmental in the old sense. In the 1930s in particular, Gramsci therefore started to develop strategies for change which assumed that: (1) the peasantry would remain in the foreseeable future as a significant political force; (2) their ethos and values would therefore have to be incorporated in any marxist theory of transition and socialism, and (3) developmentalism or modernisation would have to be re‐examined as a core part of marxist strategy.     

Further Evidence on the Anatomical Placement of the Human Eyeball for Facial Approximation and Craniofacial Superimposition*

Abstract: Recently a small sampled cadaver study (n = 4) suggested that the human eyeballs are placed closer to the orbital roof and lateral orbital wall as first reported in the anatomical literature many years previously. This contrasts with central positioning of the eyeball within the orbit as advocated by the facial approximation literature. Given the limits of such small samples, this study re-examined globe position in nine new cadavers to help clarify which relationship is accurate. The results essentially confirm prior empirical findings except that the mean lateral divergences from the orbit center were found to be larger—the eyeball was found to be “displaced” 1.4 mm superiorly and 2.4 mm laterally. Medians calculated across all 13 cadavers from this study and the above-mentioned recent report refine these measurements to 1.4 and 2.3 mm respectively. Globe projection values were identical to those observed for living individuals (c. 16 mm).
