The EU has recently mooted the possibility of harmonising minimum penalties. ‘Minimum criminal penalties’ refers to the lowest sanction available for a judge in a concrete case. Calculating the actual penalty involves legal mechanisms that might mitigate that penalty. Comparative analysis reveals that a distinction needs to be made between minimum penalties included in national criminal codes (in abstracto penalty) and the lowest penalty that might be imposed (in concreto penalty). Although in abstracto minimum penalties are found in the criminal codes of most Member States, they are fiercely opposed in others. In concreto minimum penalties that constitute an absolute limit to the discretion of a judge are even more controversial. Against that background, this contribution reviews whether or not the EU should force the Member States to impose absolute, in concreto minimum criminal penalties. This paper analyses whether foreign direct investment (FDI) has contributed to employment generation in Mexico's non-maquiladora manufacturing sector. Drawing on highly disaggregated FDI and employment data, we estimate dynamic labour demand functions for blue and white collar workers, including FDI as well as its interaction with major industry characteristics. FDI has a significantly positive, though quantitatively modest impact on manufacturing employment in Mexico. This applies to both white collar and blue collar employment. The employment enhancing effects of FDI are larger in export oriented industries. In more capital-intensive industries, the employment effect of FDI remains positive for blue collar workers but not white collar ones. 相似文献

We contribute to the lack of tools to support efficient industrial policy-making, especially in the mineral beneficiation policy literature. To address this vacuum, we adapt the product space analysis approach to incorporate an input-output value chain lens. This framework is applied to the case of steel in South Africa to derive novel insights regarding the (in)efficiency of implementing a downstream linkage-based beneficiation policy. Our dynamic analysis approach allows for interactions with the rest of the product space. We find that a ‘leap-frogging’ approach to development within the value chain may be more optimal than a strict beneficiation based industrial policy. 相似文献

AbstractIn many low-income countries, remittances are important in sustaining people’s livelihood and become even more significant during disasters. Meanwhile, the literature suggests that remittances are mainly accessible to middle and upper-income households, rather than to the poorest, thus implying differential capacities amongst households to overcome crises. The present study uses cyclone Evan that hit Samoa in December 2012 as a case study to test this hypothesis. It focuses on the village of Tafitoala and draws on interviews and participatory activities undertaken with the poorest households of the community. It indicates that the poor receive little to no remittances and that they struggled more than the rest of the community to cope with and recover from the cyclone. Their lack of access to remittances had negative consequences on the security and sustainability of their livelihoods. We conclude that remittances reproduce or even increase both inequalities and vulnerabilities existing within the community of origin. 相似文献

The debate on international South – North labour migration tends to focus on the receiving end of migration. This bias obscures a proper understanding of the developmental causes and consequences of migration at the sending end. The reciprocal migration – development relationship is examined through the discussion of seven migration ‘myths’. Because of its profound developmental roots, it is useless to think that migration can be halted or that aid and trade are short-cut ‘solutions’ to immigration. Migrant remittances contribute significantly to development and living conditions in sending countries. Nevertheless, the recent ‘remittance euphoria’ is not justified, because unattractive investment environments and restrictive immigration policies which interrupt circular migration patterns prevent the high development potential of migration from being fully realised. Although specific policies can enhance this potential through facilitating remittance transfers and investments, the key lies in encouraging circular migration. Instead of uselessly and harmfully trying to stop inevitable migration, immigration policies allowing for freer circulation can, besides increasing migration control, enhance the vital contribution of migrants to the development of their home countries. 相似文献

Voluntary agreements (VAs) negotiated between environmental regulators and polluters are increasingly popular in developing countries. According to proponents, they can sidestep weak institutions and other pervasive barriers to conventional mandatory regulation in such countries. Yet little is known about the drivers of their use and their effectiveness in poor countries. The considerable literature on voluntary initiatives in industrialized countries, where both VAs and socioeconomic conditions differ, may not apply. Using a conceptual framework drawn from the economics literature, we examine four prominent VAs in Colombia, a global leader in the use of this policy. We find that the main motive for using VAs has been to build capacity needed for broader environmental regulatory reform and that partly as a result, VAs’ additional effect on environmental performance has been limited. These findings contrast with those from industrialized country studies, which typically conclude VAs are used as a low-cost substitute for impending mandatory regulation and have few benefits because of weak regulatory pressure. Our findings suggest that in developing countries, VAs may be best suited to capacity building, not environmental management per se. 相似文献

This volume seeks to provide an integrated understanding of the Belgian political system through the prism of comparative politics. The transformation of the political system from a unitary into a federal system is used as a connecting theme linking the contributions. The volume is divided in two parts. The first part touches upon the sociological and institutional determinants of policy-making in Belgium, such as the dynamics of the Belgian federal system, the consociational features of the Belgian polity, the presence of a Belgian political culture (or of two distinct political cultures), the fragmentation of its party system and the role of political parties. Propensity-to-vote (PTV) scores are ever more commonly used in electoral research as a measure of electoral utilities. Yet a growing literature employs them as dependent variable in the voting equation in place of the lower information granted by vote recall questions. However, this choice can be seen as problematic because of the very structure of election survey research. To the extent that voters' PTVs are measured in post-election surveys (as it is often the case) these are likely to result endogenously produced by actual voting behavior in the past election – thus partly undermining the validity of the PTV question which, ideally, should not be related to any specific election. In this paper, we try to disentangle the relationship between short-term political attitudes (leader evaluations, issue proximity, economic assessments) and voters' changing patterns of propensities to vote in both an electoral and a non-electoral context. The latter scenario serves as a means to rule out the potentially contaminating effect of voting choices on voters' PTVs. Abstract Measuring quality of life in municipalities entails two empirical challenges. First, collecting a set of relevant indicators that can be compared across the municipalities in the sample. Secondly, using an appropriate aggregating tool in order to construct a synthetic index. This paper measures quality of life for the largest 237 Spanish municipalities using Value Efficiency Analysis (VEA) to derive comparative scores by combining the information contained in 19 partial indicators. VEA is a refinement of DEA (Data Envelopment Analysis) that imposes some consistency in the weights of the indicators used to construct the aggregate index. The indicators cover aspects related to consumption, social services, housing, transport, environment, labour market, health, culture and leisure, education and security. The results show that the Northern and Central regions in Spain attain the highest levels of quality of life, while the Southern regions report low living conditions. Education is the variable that requires the largest improvement in low performing municipalities, followed by health and culture facilities, pollution and crime. Population density, growth and ageing seem to relate positively to quality of life. 相似文献
