Introduction of Therapy into Tegel Prison: Evaluation of an Experiment

The revision of the Penal Code of the Federal Republic of Germany includes provision for therapeutic units in prisons. This paper reports on the first of a series of research projects designed to test the effectiveness of the largest such unit which is at Tegel Prison in Berlin. The data indicate that residents of the unit have lower reconviction rates than prisoners exposed only to orthodox penal confinement. However, there are no significant differences in outcomes for the three treatment models employed. The methodological problems involved in this kind of evaluative research are discussed.     

Turkish nationalism at its beginning: Analysis of Türk Yurdu, 1913–1918

Turkish nationalism became an element of the Ottoman political scene in the late nineteenth century. Although its roots can be traced back to the Hamidian period (1876–1909), Turkish nationalism emerged as one of the most important political ideologies during the Constitutional Regime. Wars that the Ottoman State participated in from 1911 to the end of the empire in 1918 resulted in population and land losses. Especially, following the Balkan Wars, most of the lands that were populated by non-Muslim and non-Turkish subjects were lost. Within this context, Turkish nationalism came to be seen as the most dominant ideological tool intended to save the Empire. This article argues that Turkish nationalism emerged as a reactive ideology that addressed Ottomanism and Islamism, which were the two other dominant state ideologies during the late Ottoman State, due to the changing political context. In this article, Türk Yurdu, a well-known and influential periodical, is used as the primary source of reference to demonstrate the basic features of Turkish nationalism in its infancy.     

Between the hammer and the anvil: post-conflict reconstruction,Islam and women's rights

This paper argues that gender issues are becoming politicised in novel and counterproductive ways in contexts where armed interventions usher in new blueprints for governance and ‘democratisation’. Using illustrations from constitutional and electoral processes in Afghanistan and Iraq, it analyses how the nature of emerging political settlements in environments of high risk and insecurity may jeopardise stated international commitments to a women's rights agenda. The disjuncture between stated aims and observed outcomes becomes particularly acute in contexts where security and the rule of law are severely compromised, where Islam becomes a stake in power struggles among contending factions and where ethnic/sectarian constituencies are locked in struggles of representation in defence of their collective rights.     

Voter preferences as a source of descriptive (mis)representation by social class

This paper presents the results of a conjoint survey experiment in which Swiss citizens were asked to choose among parliamentary candidates with different class profiles determined by occupation, education and income. Existing survey-experimental literature on this topic suggests that respondents are indifferent to the class profiles of candidates or biased against candidates with high-status occupations and high incomes. We find that respondents are biased against upper middle-class candidates as well as routine working-class candidates. While the bias against upper middle-class candidates is primarily a bias among working-class individuals, the bias against routine working-class candidates is most pronounced among middle-class individuals. Our supplementary analysis of observational data confirms the bias against routine working-class candidates, but not the bias against upper middle-class candidates.     

The Freedom of Expression in Global Perspective

This paper presents recent events including the Danish cartoon crisis occasion—a re-examination of John Stuart Mill’s argument for freedom of expression. Despite the appeal of liberalism, Mill’s philosophy had from the start been subject to intense criticism. The rise of political Islam opens a new phase in the debate; the difficulties pointed out by Mill’s critics are indicative of the obstacles that liberalism still faces.

The German Civil Code of 1896: An Economic Interpretation

The 19th century has seen some large codifications, several of which such as the Code de Napoleon of 1804 and the German Civil Code of 1900 have shown remarkable longevity. This article deals with the economists' influence on the German Civil Code of 1900. It is argued that the economists played an important role in re-shaping the Code, that this was even a concerted effort, and that Otto von Gierke's legal doctrine proved to be particularly viable for the introduction of economic ideas into legal reasoning.     

On the Spatial-temporal Diffusion of Community Based Policing from Japan to Peninsula Southeast Asia: The Case of Timor-Leste

ABSTRACT

This article traces the legacies and variances of ‘community based policing’ in Timor-Leste, and inquires about historical trajectories and cross-cultural sociopolitical influences which forged and determined the idea of policing in Timor-Leste. By drawing on diffusion theory, the article investigates the changing interpretations and transformations of ‘community based policing’ from the Imperial Japanese koban policing, to its Indonesian babinsa- and bimpolda-variant through to the current Timorese ofisial polísia suku approach. It delivers a historically based explanation for the difficulties and challenges of implementing an approach to ‘community based policing’ in Timor-Leste during UNTAET and following missions of the United Nations.     

Mixing Grand Strategies: Trump and International Security

ABSTRACT

When a new President is elected in the United States, the first thing analysts do is define that President’s grand strategy; yet, naming Donald Trump’s grand strategy was a difficult task as his pre-election speeches often contradicted traditional US foreign policy norms. Trump’s ambiguous grand strategy combines two US foreign policy strategies: nationalism in the sense that his preference is for unilateral policies prioritising American interests, and a traditional foreign policy approach, as seen in the moves taken against China and Iran. Surprisingly, this grand strategy unintentionally contributes to cooperation in Eurasia, as actors like Russia, China, Turkey, India and the European Union continue to try to balance the threat from the United States instead of competing with each other, while smaller countries are reluctant to challenge the regional powers due to mistrust towards Trump.     

Where does learning take place? The role of intergovernmental cooperation in policy diffusion

Although it is widely accepted that a decentralised system can enhance policy learning and the spread of best practices, an under‐researched question is where that learning process takes place. Using data on the diffusion of health care policies in Switzerland, this article analyses the role of institutionalised intergovernmental cooperation and its impact on the spread of successful policies. The results show that joint membership of policy makers in health policy specific intergovernmental bodies is related to the diffusion of best practices.
