This article examines the manner in which hazardous waste, alreadybeing labeled the major environmental issue of the 1980s, isbeing accommodated in a period of evolving intergovernmentalrelations. Hazardous waste is a technological problem with economicovertones and political consequences. The governmental mechanismsset up to tackle the issue are understandably complex and, someobservers argue, fall short of the mark. In terms of federalism, the year 1992-1993 was interesting inits ambivalence. The new president and a somewhat reconstitutedCongress took actions that reverberated through the intergovernmentalsystem; yet there was no hint of a coherent theory of federalismunderlying those actions. This article discusses different forms of military force under or linked to the principle of the responsibility to protect (R2P) in relation to international law, with particular emphasis on humanitarian intervention. It contributes to the ongoing debate by analysing and separating the lawful forms of military force falling under Pillars II and III of the R2P from unlawful claims and extensive interpretations of R2P. Apart from the already existing legal right of the Security Council to authorise humanitarian interventions, it is argued that there are no ongoing legal customary developments of similar rights or obligations for other actors to intervene in another state (without consent) to protect populations by military force against grave crimes under the principle of R2P. The argumentation is based on a series of case studies of humanitarian interventions by the Security Council, regional organisations and “coalitions of willing states”. The article also includes legal analysis on the Uniting for Peace Procedure and the prior treaty-based consented rights to intervention under the African Union Act and the 1999 ECOWAS Protocol on the Mechanism for Conflict Prevention. 相似文献

ABSTRACTAfter almost 20 years with Resolution 1325 and the ‘women, peace and security’ agenda, the results achieved seem rather disappointing. This article analyses how the global gender norms laid out in Resolution 1325 have been translated into practice in a local post-conflict setting – Rwanda as a ‘best-case’ scenario on gender equality. Drawing on the theoretical literature on norm translation and the concepts of friction and flows, together with fieldwork-based research, the article analyses how international and national actors in Rwanda have reshaped and adapted the principles laid out in Resolution 1325. The main argument is that the processes of norm translation in Rwanda are characterised less by flows and more by friction and uneven processes of translation. The article concludes that the predominant successes are the inclusion of women in decision-making and at the lower levels in the security sector. However, women are still excluded, and gender issues marginalised, in the ‘big’ negotiations on peace and security, and high levels of violence against women persist. 相似文献

The present paper deals with the development of wage distribution by educational attainment in the Czech Republic in the years of 2003-2012, analyzing 50 wage distributions as the object of research and the gross monthly wage in CZK (Czech Koruna) as the research variable. It examines the development of wage distribution in time and the gross monthly wage in relation to the level of educational attainment. It also pursues the development of the minimum wage in the monitored period. The author pays special attention to the lowest guaranteed wage levels classified according to wage classes and work capability assessment, comparing the minimum wage with the wage of subsistence. The forecasts of future wage distribution are an integral component of the research. Comparison of wage levels in the world and the position of wages of the Czech employees in the international context are included, too. 相似文献
