Prävention zur Vermeidung von Unfällen und von Umweltverschmutzung auf See

Als Folge spektakul?rer Unf?lle, wie des Untergangs der „Erika“ (1999) und der „Prestige“ (2002) mit erheblicher Meeresverschmutzung an den Küsten Frankreichs und Spaniens, hat die Europ?ische Gemeinschaft mit diversen neuen Verordnungen und Richtlinien zu Schiffssicherheit, Unfallmanagement auf See und zum schiffsabh?ngigen Meeresumweltschutz gesetzgeberisch eingegriffen. Sie tritt damit als regionaler Gesetzgeber in Konkurrenz zu der weltweit zust?ndigen Internationalen Schifffahrtsorganisation IMO. Diese Entwicklung ist Teil einer neuen maritimen Politik, mit der Europa sich auf das begonnene ozeanische Jahrhundert einstellt. Nach Erika I und II ist das Erika III Paket mit sieben Vorschl?gen die jüngste und zugleich umfangreichste Initiative zur Versch?rfung der Schiffskontrollen in den Gew?ssern der EU.     

A case study on anonymised sharing platforms and digital traces left by their usage

Non-local forms of file storage and transfer provide investigatory concerns. Whilst mainstream cloud providers offer a well-established challenge to those involved in criminal enquiries, there are also a host of services offering non-account based ‘anonymous’ online temporary file storage and transfer. From the context of a digital forensic investigation, the practitioner examining a suspect device must detect when such services have been utilised by a user, as offending files may not be resident on local storage media. In addition, identifying the use of a service may also expose networks of illegal file distribution, supporting wider investigations into criminal activity. This work examines 16 anonymous file transfer services and identifies and interprets the digital traces left behind on a device following their use to support law enforcement investigations.     

Whole bovine blood use in forensic research: Sample preparation and storage considerations

Mammalian whole blood sources are often used for forensic research and training when human samples cannot be sourced. While porcine, ovine and equine blood have been shown to be viable alternatives to whole human blood for forensic purposes, procurement can still pose a problem, especially for smaller and remote institutions. This work explores the use of whole bovine blood for basic bloodstain simulation. Sample preparation through the addition of ACD-A anticoagulant was optimized and storability was explored. Viscosity, surface tension, density, and packed cell volume, four fluid properties relevant to bloodstain pattern analysis, were monitored over four days and in two temperature conditions. Linear mixed models accounting for variation in the donor demonstrated that these fluid properties of the bovine blood changed predictably over time and with temperature. Whole bovine blood with 12.5% v/v ACD-A was found to be viable for use in basic bloodstain simulation at ambient and physiological temperature.

SUMMARY

In this article Colin Brooks reviews the historical writing of the last thirty years on British history between 1688 and 1714. This has offered a variety of interpretations which give priority to a number of different factors. The problem now facing historians is how to synthesize these interpretations into a coherent account. The article suggests that while it is possible to reconstruct from the surviving source materials what happened in the House of Commons, the incompleteness and the ambiguities of the evidence make it much more difficult to determine why it happened, or what were the motives of the individuals taking part. The nature of the source materials requires that they be interpreted with more caution than they have often received: they have as much to tell about individual perceptions as about what actually happened.     

Das ABGB und das Sondermietrecht – die Entwicklung der vergangenen 100?Jahre

Aus Anlass des im Vorjahr vielfach gefeierten 200. Geburtstags des ABGB zeichnet der Beitrag die Entwicklung des Mietrechts nach, wobei – diesem Anlass entsprechend – das Bestandrecht des ABGB im Mittelpunkt steht. Die Rückschau konzentriert sich auf die Entwicklungslinien im Gesetzesrecht und beschr?nkt sich daher – mangels eines Legislativgeschehens zum Mietrecht im ersten Geltungsjahrhundert des ABGB – auf die vergangenen 100 Jahre. Die judikative Ausgestaltung der Gesetzeslage wird nur in gro?en Zügen angesprochen; auch hier liegt der Fokus in der Rechtsprechung zum ABGB-Bestandrecht.
