Work activity of persons working as members of advisory committees established under the Federal Advisory Committee Act (FACA). Final rule

We are revising our disability regulations under titles II and XVI of the Social Security Act to establish a new, special rule that affects individuals who are receiving payments or providing services as members or consultants of a committee, board, commission, council or similar group established under the Federal Advisory Committee Act (FACA). Under this special rule, we will not count any earnings an individual is receiving from serving as a member or consultant of a FACA advisory committee when we determine if the individual is engaging in substantial gainful activity under titles II and XVI of the Social Security Act (the Act). In addition, we will not evaluate any of the services the individual is providing as a member or consultant of the FACA advisory committee when determining if the individual has engaged in substantial gainful activity under titles II and XVI of the Act. Based on our experience with FACA advisory committees and the frequency and level of activity required by these committees, we believe that performance of activity on these committees does not demonstrate the ability to perform substantial gainful activity. We believe this to be consistent with Congress's view, as it has recognized in creating the Ticket to Work advisory committee, for example, that current disability beneficiaries should be considered for membership. This also will encourage individuals with disabilities to serve on FACA advisory committees, thereby providing the benefit of their unique perspective on policies and programs to the Federal Government.     

服务型政府建设的浙江经验

与市场化进程和社会治理体系发育互动演进的政府改革是"浙江模式"的重要组成部分。浙江服务型政府建设包含三个层面的内容:转变施政理念,实现从"发展型政府"向"服务型政府"转变;推进制度建设,实现从政府职能"重新定位"向"全面履行"转变;创新政策工具,实现从公共服务的"单一供给模式"向"复合供给模式"转变。但浙江服务型政府建设仍然面临着深入推进的现实困境。当前我国的权力配置结构未发生重大调整,地方政府行为逻辑未发生实质性转变,是服务型政府建设推进艰难的重要原因。在法治的框架下,以调整政府层级间关系为突破口,建立"混合型行政管理体制",增强地方政府自主性,加强社会问责,确保政府职能全面履行,是服务型政府建设的重要路径。     

公共事务复合治理的载体、实践及其走势分析——以杭州运河综保工程为例

以跨部门的复合治理方式取代碎片化的单一治理方式已成为公共事务治道变革的主要趋向。社会复合主体作为杭州首创的公共事务新型治理载体,因其良好的治理绩效而受到国内学界的较大关注。本文基于复合治理理论诠释了社会复合主体的生成及其意义,对杭州运河综保工程的复合治理实践进行个案剖析,并在反思个案运行困境的基础上,对社会复合主体发展的主客观条件及其走势作了讨论和展望。     

社会资本对农民工信任流入地政府的影响研究

农民工已然成为我国城市建设和经济发展的中坚力量,但由于户籍制度和城乡二元体制的影响,他们无法得到城市、农村两地政府的有效服务和管理,导致他们对政府的信任感偏低。本文利用西安交通大学人口与发展研究所2008年12月在陕西省X市LH区对农民工进行实地调查所获得的数据,以政府信任理论和社会资本理论作为理论基础,对西部农民工信任流入地政府现状及影响因素进行研究。研究结果发现,高素质、年轻一代的农民工对流入地政府的信任感低;社会资本越丰富的农民工越信任流入地政府;政治活动参与意愿越强、社会经济地位越高的农民工则越不信任流入地政府。     

社会群体性突发事件的应急管理机制研究——以北京市为例

社会群体性突发事件是经济转轨、社会转型中利益矛盾和冲突的一种尖锐表现,认识和处置不当会对社会稳定与和谐发展造成严重影响。本文在已有研究成果的基础上,指明了北京市社会群体性突发事件的特殊性,分析了北京市社会群体性突发事件应急管理机制的现状及问题,进而提出有针对性的对策与建议。     

小城镇服务业人才培养问题研究

劳动力市场人才资源的配置问题是小城镇服务业发展中急需解决的重要问题之一。本文从用人单位满意度分析的基础上,采用模糊综合评价法对当前小城镇服务业劳动力需求与人才培养对接问题现状进行了评价,发现劳动力市场人才资源的配置与人才培养供给之间出现了严重的失衡。人才培养只有遵循劳动力市场需求,动态地调整培训方案与体系,才能够健康持续地发展。     

政府部门知识共享行为的实证研究

本文从政府部门的信息技术水平,政府部门个体的知识共享动机,以及政府知识共享的组织氛围等维度构建政府部门知识共享行为的理论模型。论文采用大样本问卷调查的方法在政府部门公务人员中开展实证研究,对模型的适用性进行检验。研究结果表明,政府部门的外部奖励对个体知识共享意愿之间没有相关关系,知识共享意愿与知识共享的组织氛围对于知识共享行为的影响作用非常大。研究结论可为政府部门提高公务员的知识共享行为提供有益借鉴。     

中国服务型政府建设的基本经验与未来

服务型政府是落实科学发展观的根本途径,也是政府改革的重要目标。近十年来,通过确立服务型政府基本理念、构建基本公共服务体系和改革公共财政体制、创新公共服务供给机制等,我国服务型政府建设取得了重要进展。但政府间职责分工不合理,社会政策体系整体规划缺失,以及公共服务供给机制不完善,使得发展型政府难以超越,政府转型远未完成。在新的历史起点上建设服务型政府,除了进一步明确服务型政府建设的目标,巩固、确立新的政府管理体制和社会政策体系等制度基础外,关键在于为政府转型构建一个强有力的社会基础。     

How we collect and consider evidence of disability. Final rule

We are modifying the requirement to recontact your medical source(s) first when we need to resolve an inconsistency or insufficiency in the evidence he or she provided. Depending on the nature of the inconsistency or insufficiency, there may be other, more appropriate sources from whom we could obtain the information we need. By giving adjudicators more flexibility in determining how best to obtain this information, we will be able to make a determination or decision on disability claims more quickly and efficiently in certain situations. Eventually, our need to recontact your medical source(s) in many situations will be significantly reduced as a result of our efforts to improve the evidence collection process through the increased use of Health Information Technology (HIT).     

Medical devices; immunology and microbiology devices; classification of norovirus serological reagents. Final rule

The Food and Drug Administration (FDA) is classifying norovirus serological reagents into class II (special controls). The special control that will apply to these devices is the guidance document entitled ``Class II Special Controls Guidance Document: Norovirus Serological Reagents.' The Agency is classifying these devices into class II (special controls) because special controls, in addition to general controls, will provide a reasonable assurance of safety and effectiveness of these devices and there is sufficient information to establish special controls.
